{"data":{"id":"us-ky/krs-403.7521","jurisdiction":"us-ky","citation":"KRS 403.7521","heading":"Foreign protective orders -- Rebuttable presumption of validity --","body":"Enforcement -- Civil and criminal proceedings mutually exclusive.\n(1) All foreign protective orders shall have the rebuttable presumption of validity. The\nvalidity of a foreign prot ective order shall only be determined by a court of\ncompetent jurisdiction. Until a foreign protective order is declared to be invalid by a\ncourt of competent jurisdiction, it shall be given full faith and credit by all peace\nofficers and courts in the Commonwealth.\n(2) All peace officers shall treat a foreign protective order as a legal document valid in\nKentucky, and shall make arrests for a violation thereof in the same manner as for a\nviolation of an order of protection issued in Kentucky.\n(3) The fact that a foreign protective order has not been entered into the Law\nInformation Network of Kentucky shall not be grounds for a peace officer not to\nenforce the provisions of the order unless it is readily apparent to the peace officer\nto whom the order is pr esented that the order has either expired according to a date\nshown on the order, or that the order's provisions clearly do not prohibit the conduct\nbeing complained of. Officers acting in good faith shall be immune from criminal\nand civil liability.\n(4) If the order has expired or its provisions do not prohibit the conduct being\ncomplained of, the officer shall not make an arrest unless the provisions of a\nKentucky statute have been violated, in which case the peace officer shall take the\naction required by Kentucky law.\n(5) Civil proceedings and criminal proceedings for violation of a foreign protective\norder for the same violation of the protective order shall be mutually exclusive.\nOnce either proceeding has been initiated, the other shall not be underta ken,\nregardless of the outcome of the original proceeding.","path":["KRS Chapter 403"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44758","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:30Z","sha256":"c6f7b15cbfaddce8617f58aca38ef7dab69431d4c4e212807fb6af10c17b9d51","source_id":"us-ky","stale":false,"prev":"us-ky/krs-403.751","next":"us-ky/krs-403.7524"},"notice":"GroundRules: Original legal text.
