{"data":{"id":"us-ky/krs-403.754","jurisdiction":"us-ky","citation":"KRS 403.754","heading":"Petitioner for protective order may apply for temporary permit to carry","body":"concealed deadly weapon -- Criteria -- Denial of application final -- Conversion\nto concealed carry license -- Automated listing of temporary permit holders.\n(1) A petitioner for an order of protection granted under KRS 403.715 to 403.785 may\napply for a temporary permit to carry a concealed deadly weapon on or about his or\nher person into those places and under the same conditions as a person holding a\ncarry concealed deadly weapon license issued under KRS 237.110.\n(2) To request a temporary permit authorized by this section, the petitioner shall apply\nelectronically for a license to carry a concealed deadly weapon in the manner set\nforth in KRS 237.110 and administrative regulation promulgated by the Department\nof Kentucky State Police, unless the electronic application is unavailable. If the\nelectronic application is unavailable, applications for temporary permits under this\nsection shall not be accepted.\n(3) Prior to the issuanc e of a temporary permit authorized by this section, the\nDepartment of Kentucky State Police, upon receipt of a completed application,\napplication fee, and any documentation required by KRS 237.110 or administrative\nregulation promulgated by the Department of Kentucky State Police, shall conduct\nthe background check as set forth in KRS 237.110.\n(4)  The Department of Kentucky State Police shall issue a temporary permit authorized\nby this section if the applicant is not disqualified under the standards set fo rth in\nKRS 237.110(4)(a) to (h).\n(5) A temporary permit issued under this section shall be valid for forty -five (45) days\nfrom the date of issuance and not be subsequently extended or reissued. A\ntemporary permit which has expired shall be void and shall n ot be valid for any\npurpose.\n(6) The Department of Kentucky State Police shall, within one (1) working day or as\nsoon as practically possible after the date of receipt of the completed application, a\nrecent color photograph of the applicant, and, for appli cants who are not citizens of\nthe United States, any documentation required under KRS 237.110, either issue the\ntemporary permit or deny the application based solely on the grounds that the\napplicant fails to qualify under the criteria set forth in KRS 237.110.\n(7) In order to convert the temporary permit issued under this section into a license to\ncarry a concealed deadly weapon issued under KRS 237.110, the applicant shall\nmeet the firearms safety training requirement under KRS 237.110(4) within the\nforty-five (45) day period the temporary permit is valid. If firearms safety training is\nnot completed within the forty -five (45) day temporary permit period, a new\napplication for a license to carry a concealed deadly weapon shall be required.\n(8) If the Depa rtment of Kentucky State Police denies the application for a temporary\npermit, that decision shall be final but the applicant's application for a license to\ncarry a concealed deadly license shall continue to be processed and either issued or\ndenied in accordance with KRS 237.110.\n(9) The holder of a permit issued under this section shall carry the permit at all times\nthe permit holder is carrying a concealed firearm or other deadly weapon and shall\ndisplay the permit upon request of a law enforcement office r. Violation of the\nprovisions of this subsection shall constitute a noncriminal violation with a penalty\nof twenty-five dollars ($25), payable to the clerk of the District Court, but no court\ncosts shall be assessed.\n(10) The Department of Kentucky State Police shall maintain an automated listing of\ntemporary permit holders and pertinent information under the same circumstances\nand restrictions set forth in KRS 237.110.\n(11) Nothing in this section shall authorize the carrying of a concealed deadly weapon by\na person prohibited from possessing such a weapon by state or federal law.","path":["KRS Chapter 403"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43451","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:30Z","sha256":"6204550ce88509b42d3364eedb327a23eb5551709f4e4a09cec7084770b1b810","source_id":"us-ky","stale":false,"prev":"us-ky/krs-403.7539","next":"us-ky/krs-403.755"},"notice":"GroundRules: Original legal text.
