{"data":{"id":"us-ky/krs-403.761","jurisdiction":"us-ky","citation":"KRS 403.761","heading":"Amendment of domestic violence order to require participation in global","body":"positioning monitoring system -- Cost to be paid by respondent and system\noperator -- Shortening or vacating of order -- Penalty for violation.\n(1) Upon a petitioner's request a nd after an evidentiary hearing, a court may amend a\ndomestic violence order to require a respondent to participate in a global positioning\nmonitoring system if:\n(a) The respondent has committed a substantial violation of a previously entered\ndomestic violence order;\n(b) The court has reviewed an updated history of the respondent's Kentucky\ncriminal and protective order history; and\n(c) The court makes a factual determination that the use of a global positioning\nmonitoring system would increase the petitioner's safety.\n(2) An order requiring participation in a global positioning monitoring system shall:\n(a) Require the respondent to pay the cost of participation up to the respondent's\nability to pay, with the system operator bearing any uncovered costs for\nindigent respondents;\n(b) State with specificity the locations or areas where the respondent is prohibited\nfrom being located or persons with whom the respondent shall have no\ncontact;\n(c) Include the date that the order expires, which shall be no longer th an the\nexpiration date of the domestic violence order, although participation may be\nextended if the underlying order is extended;\n(d) Require the entity that operates the monitoring system to immediately notify\nthe petitioner, the local law enforcement ag ency named in the order, and the\ncourt if a respondent violates the order; and\n(e) Include any other information as the court deems appropriate.\n(3) The Administrative Office of the Courts shall prepare a publicly available\ninformational pamphlet containin g information on the method of applying for,\nhearing, amending, and terminating an order requiring participation in a global\npositioning monitoring system.\n(4) (a) The Supreme Court may establish by rule a sliding scale of payment\nresponsibility for indige nt defendants for use in establishing required\npayments under subsection (2) of this section.\n(b) A person, county, or other organization may voluntarily agree to pay all or a\nportion of a respondent's monitoring costs specified in this section.\n(5) An order requiring participation in a global positioning monitoring system may be\nshortened or vacated by the court either:\n(a) Upon request of the petitioner; or\n(b) Upon request of the respondent after an evidentiary hearing, if the respondent\nhas not violated the order and:\n1. Three (3) months have elapsed since the entry of the order; and\n2. No previous request has been made by the respondent in the previous six\n(6) months.\n(6) A respondent who fails to wear, removes, tampers with, or destroys a global\npositioning monitoring system device in contravention of an order entered under\nthis section shall be guilty of a Class D felony.","path":["KRS Chapter 403"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44764","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:30Z","sha256":"931b6235a4cc03d65074e2974ad74c90da2f5c778dd8b3c64924214e2b92e5a8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-403.760","next":"us-ky/krs-403.762"},"notice":"GroundRules: Original legal text.
