{"data":{"id":"us-ky/krs-403.828","jurisdiction":"us-ky","citation":"KRS 403.828","heading":"Temporary emergency jurisdiction.","body":"(1) A court of this state has temporary emergency jurisdiction if the child is present in\nthis state and the child has been abandoned or it is necessary in an emergency to\nprotect the child because the child, or a sibling or parent of the child, is subjected t o\nor threatened with mistreatment or abuse.\n(2) If there is no previous child custody determination that is entitled to be enforced\nunder KRS 403.800 to 403.880 and a child custody proceeding has not been\ncommenced in a court of a state having jurisdiction  under KRS 403.822, 403.824,\nand 403.826, a child custody determination made under this section remains in\neffect until an order is obtained from a court of a state having jurisdiction under\nKRS 403.822, 403.824, and 403.826. If a child custody proceeding has not been or\nis not commenced in a court of a state having jurisdiction under KRS 403.822,\n403.824, and 403.826, a child custody determination made under this section\nbecomes a final determination, if it so provides and this state becomes the home\nstate of the child.\n(3) If there is a previous child custody determination that is entitled to be enforced\nunder KRS 403.800 to 403.880, or a child custody proceeding has been commenced\nin a court of a state having jurisdiction under KRS 403.822, 403.824, and 4 03.826,\nany order issued by a court of this state under this section shall specify in the order a\nperiod that the court considers adequate to allow the person seeking an order to\nobtain an order from the state having jurisdiction under KRS 403.822, 403.824 , and\n403.826. The order issued in this state remains in effect until an order is obtained\nfrom the other state within the period specified or the period expires.\n(4) A court of this state which has been asked to make a child custody determination\nunder this section, upon being informed that a child custody proceeding has been\ncommenced in, or a child custody determination has been made by, a court of a state\nhaving jurisdiction under KRS 403.822, 403.824, and 403.826, shall immediately\ncommunicate with the  other court. A court of this state which is exercising\njurisdiction pursuant to KRS 403.822, 403.824, and 403.826, upon being informed\nthat a child custody proceeding has been commenced in, or a child custody\ndetermination had been made by, a court of ano ther state under a statute similar to\nthis section shall immediately communicate with the court of that state to resolve\nthe emergency, protect the safety of the parties and the child, and determine a period\nfor the duration of the temporary order.","path":["KRS Chapter 403"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17508","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:31Z","sha256":"3145a36442c85b72f7bc67254bdd34e799170b9ad3ff3ca018ecc7f2cbf0c556","source_id":"us-ky","stale":false,"prev":"us-ky/krs-403.826","next":"us-ky/krs-403.830"},"notice":"GroundRules: Original legal text.
