{"data":{"id":"us-ky/krs-403.832","jurisdiction":"us-ky","citation":"KRS 403.832","heading":"Simultaneous proceedings.","body":"(1) Except as otherwise provided in KRS 403.828, a court of this state shall not\nexercise jurisdiction under Article 2 if, at the time of the commencement of the\nproceeding, a proceeding concerning the custody of the child has been commenced\nin a court of anot her state having jurisdiction substantially in conformity with KRS\n403.800 to 403.880, unless the proceeding has been terminated or is stayed by the\ncourt of the other state because a court of this state is a more convenient forum\nunder KRS 403.834.\n(2) Except as otherwise provided in KRS 403.828, a court of this state, before hearing a\nchild custody proceeding, shall examine the court documents and other information\nsupplied by the parties pursuant to KRS 403.828. If the court determines that a child\ncustody proceeding has been commenced in a court in another state having\njurisdiction substantially in accordance with KRS 403.800 to 403.880, the court of\nthis state shall stay its proceeding and communicate with the court of the other state.\nIf the court of t he state having jurisdiction substantially in accordance with KRS\n403.800 to 403.880 does not determine that the court of this state is a more\nappropriate forum, the court of this state shall dismiss the proceeding.\n(3) In a proceeding to modify a child cu stody determination, a court of this state shall\ndetermine whether a proceeding to enforce the determination has been commenced\nin another state. If a proceeding to enforce a child custody determination has been\ncommenced in another state, the court may:\n(a) Stay the proceeding for modification pending the entry of an order of the other\nstate enforcing, staying, denying, or dismissing the proceeding for\nenforcement;\n(b) Enjoin the parties from continuing with the proceeding for enforcement; or\n(c) Proceed with the modification under conditions it considers appropriate.","path":["KRS Chapter 403"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17510","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:31Z","sha256":"921527338e5278ce5a80fff8ff8bd651e33b07fd93da66c01ad12b7cbf557c02","source_id":"us-ky","stale":false,"prev":"us-ky/krs-403.830","next":"us-ky/krs-403.834"},"notice":"GroundRules: Original legal text.
