{"data":{"id":"us-ky/krs-403.838","jurisdiction":"us-ky","citation":"KRS 403.838","heading":"Information to be submitted to court.","body":"(1) In a child custody proceeding, each party, in its first pleading or in an attached\naffidavit, shall give information, if reasonably ascertainable, under oath as to the\nchild's present address or whereabouts, the places where the child has lived during\nthe last five (5) years, and the names and present addresses of the persons with\nwhom the child has lived during that period. The pleading or affidavit shall state\nwhether the party:\n(a) Has participated, as a party or witness or in any other capacity, in any other\nproceeding concerning the custody of or visitation with the child and, if so,\nidentify the court, the case number, and the date of the child custody\ndetermination, if any;\n(b) Knows of any proceeding that could affect the current proceeding, includin g\nproceedings for enforcement and proceedings relating to domestic violence,\nprotective orders, termination of parental rights, and adoptions and, if so,\nidentify the court, the case number, and the nature of the proceeding; and\n(c) Knows the names and add resses of any person not a party to the proceeding\nwho has physical custody of the child or claims rights of legal custody or\nphysical custody of, or visitation with, the child and, if so, the names and\naddresses of those persons.\n(2) If the information re quired by subsection (1) of this section is not furnished, the\ncourt, upon motion of a party or its own motion, may stay the proceeding until the\ninformation is furnished.\n(3) If the declaration as to any of the items described in subsection (1) of this se ction is\nin the affirmative, the declarant shall give additional information under oath as\nrequired by the court. The court may examine the parties under oath as to the details\nof the information furnished and other matters pertinent to the court's jurisdi ction\nand the disposition of the case.\n(4) Each party has a continuing duty to inform the court of any proceeding in this or any\nother state that could affect the current proceeding.\n(5) If a party alleges in an affidavit or a pleading under oath that the health, safety, or\nliberty of a party or child would be jeopardized by disclosure of identifying\ninformation, the information shall be sealed and shall not be disclosed to the other\nparty or the public unless the court orders the disclosure to be made afte r a hearing\nin which the court takes into consideration the health, safety, or liberty of the party\nor child and determines that the disclosure is in the interest of justice.","path":["KRS Chapter 403"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17513","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:31Z","sha256":"2b9df20d6cbb958b3a0972d8a0fd82c1a43dceefff8bfecc7da2bb4641292274","source_id":"us-ky","stale":false,"prev":"us-ky/krs-403.836","next":"us-ky/krs-403.840"},"notice":"GroundRules: Original legal text.
