{"data":{"id":"us-ky/krs-403.862","jurisdiction":"us-ky","citation":"KRS 403.862","heading":"Warrant to take physical custody of child.","body":"(1) Upon the filing of a petition seeking enforcement of a child custody determination,\nthe petitioner may file a verified application for the issuance of a warrant to take\nphysical custody of the child if the child is immediately likely to suffer serious\nphysical harm or be removed from this state.\n(2) If the court, upon the testimony of the petitioner or other witness, finds that the\nchild is imminently likely to suffer serious physical harm or be removed from this\nstate, it may issue a warrant to take physic al custody of the child. The petition shall\nbe heard on the next judicial day after the warrant is executed unless that date is\nimpossible. In that event, the court shall hold the hearing on the first judicial day\npossible. The application for the warrant shall include the statements required by\nKRS 403.856(2).\n(3) A warrant to take physical custody of a child shall:\n(a) Recite the facts upon which a conclusion of imminent serious physical harm\nor removal from the jurisdiction is based;\n(b) Direct law enfor cement officers to take physical custody of the child\nimmediately; and\n(c) Provide for the placement of the child pending final relief.\n(4) The respondent shall be served with the petition, warrant, and order immediately\nafter the child is taken into physical custody.\n(5) A warrant to take physical custody of a child is enforceable throughout this state. If\nthe court finds, on the basis of the testimony of the petitioner or other witness that a\nless intrusive remedy is not effective, it may authorize law en forcement officers to\nenter private property to take physical custody of the child. If required by exigent\ncircumstances of the case, the court may authorize law enforcement officers to\nmake a forcible entry at any hour.\n(6) The court may impose conditions  upon placement of a child to ensure the\nappearance of the child and the child's custodian.","path":["KRS Chapter 403"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17525","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:31Z","sha256":"a10642c51325b2afaf4ad1f614d1b5f8dbf0a92dd2029da80205f56b1a321f9c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-403.860","next":"us-ky/krs-403.864"},"notice":"GroundRules: Original legal text.
