{"data":{"id":"us-ky/krs-403a.105","jurisdiction":"us-ky","citation":"KRS 403A.105","heading":"Notification required of deploying parent.","body":"(1) Except as otherwise provided in subsection (4) of this section, and subject to\nsubsection (3) of this section, a deploying parent shall notify in a record the other\nparent of a pending deployment not later than seven (7) days after receiving notice\nof deployment unless reasonably prevented from doing so by the circumstances of\nservice. If the circumstances of service prevent giving notification within the seven\n(7) days, the deploying parent shall give the notification as soon as reasonably\npossible.\n(2) Except as otherwise provided in subsection (4) of this section, and subject to\nsubsection (3) of this section, each parent shall provide in a record the other parent\nwith a plan for fulfilling that parent's share of custodial responsibility during\ndeployment. Each parent shall provide the plan as soon as reasonably possible after\nnotification of deployment is given under subsection (1) of this section.\n(3) If a court order currently in effect prohibits disclosure of the address or contact\ninformation of the o ther parent, notification of deployment under subsection (1) of\nthis section, or notification of a plan for custodial responsibility during deployment\nunder subsection (2) of this section, may be made only to the issuing court. If the\naddress of the other parent is available to the issuing court, the court shall forward\nthe notification to the other parent. The court shall keep confidential the address or\ncontact information of the other parent.\n(4) Notification in a record under subsection (1) or (2) of th is section is not required if\nthe parents are living in the same residence and both parents have actual notice of\nthe deployment or plan.\n(5) In a proceeding regarding custodial responsibility, a court may consider the\nreasonableness of a parent's efforts to comply with this section.","path":["KRS Chapter 403A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51174","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:31Z","sha256":"f5fc2b65580c66dc23dfde2b42b806a59a0b773c60d19653507740d47c8fdeb4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-403a.103","next":"us-ky/krs-403a.106"},"notice":"GroundRules: Original legal text.
