{"data":{"id":"us-ky/krs-403a.201","jurisdiction":"us-ky","citation":"KRS 403A.201","heading":"Form of agreement.","body":"(1) The parents of a child may enter into a temporary agreement under KRS 403A.201\nto 403A.205 granting custodial responsibility during deployment.\n(2) An agreement under subsection (1) of this section shall be:\n(a) In writing; and\n(b) Signed by both parents a nd any nonparent to whom custodial responsibility is\ngranted.\n(3) Subject to subsection (4) of this section, an agreement under subsection (1) of this\nsection, if feasible, shall:\n(a) Identify the destination, duration, and conditions of the deployment tha t is the\nbasis for the agreement;\n(b) Specify the allocation of caretaking authority among the deploying parent, the\nother parent, and any nonparent;\n(c) Specify any decision-making authority that accompanies a grant of caretaking\nauthority;\n(d) Specify any grant of limited contact to a nonparent;\n(e) If under the agreement custodial responsibility is shared by the other parent\nand a nonparent, or by other nonparents, provide a process to resolve any\ndispute that may arise;\n(f) Specify the frequency, durati on, and means, including electronic means, by\nwhich the deploying parent will have contact with the child, any role to be\nplayed by the other parent in facilitating the contact, and the allocation of any\ncosts of contact;\n(g) Specify the contact between the deploying parent and child during the time the\ndeploying parent is on leave or is otherwise available;\n(h) Acknowledge that any party's child -support obligation cannot be modified by\nthe agreement, and that changing the terms of the obligation during the\ndeployment requires modification in the appropriate court;\n(i) Provide that the agreement will terminate according to the procedures under\nKRS 403A.401 to 403A.404 after the deploying parent returns from\ndeployment; and\n(j) If the agreemen t must be filed pursuant to KRS 403A.205, specify which\nparent is required to file the agreement.\n(4) The omission of any of the items specified in subsection (3) of this section does not\ninvalidate an agreement under this section.","path":["KRS Chapter 403A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51177","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:31Z","sha256":"a3a9cadd92e18947938599adc64f8ce69a774e74230c5f0ed0b3f4b4b1e8abbf","source_id":"us-ky","stale":false,"prev":"us-ky/krs-403a.107","next":"us-ky/krs-403a.202"},"notice":"GroundRules: Original legal text.
