{"data":{"id":"us-ky/krs-405.450","jurisdiction":"us-ky","citation":"KRS 405.450","heading":"Dispute hearings -- Appeal -- Payment during pendency of appeal --","body":"Contested obligation amount during modification review.\n(1) A hearing officer appointed by the Office of Administrative Hearings within the\nDepartment of Law sha ll conduct dispute hearings in the county of the child or\nparent's residence or any other location acceptable to the parent, which shall be\nscheduled within sixty (60) days of the parent's request for a hearing. The dispute\nhearing proceedings shall be conducted in accordance with KRS Chapter 13B.\n(2) The parent's obligation to pay minimum monthly support shall be stayed until the\nparent's receipt of the final order.\n(3) The parent or the Office of the Attorney General may file an appeal in the Circuit\nCourt in the county of the parent's or the child's residence in accordance with KRS\nChapter 13B.\n(4) The parent shall, during the pendency of the parent's appeal from the final order,\nabsent a showing of indigency or need exceeding the child's need, pay the minimum\nmonthly support obligation to the office, which shall, if the parent's appeal is\nsuccessful, return his or her money together with interest at the legal rate for\njudgments.\n(5) If the Office of the Attorney General elects to conduct the modification review as\nspecified in KRS 405.430(6), either party may contest the adjustment to the\nobligation amount within thirty (30) days after the date of the notice of the\nadjustment by requesting a review under subsection (1) of this section and, if\nappropriate, a request for adjustment of the order as permitted by this chapter.","path":["KRS Chapter 405"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56592","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:32Z","sha256":"4e30e0a617bcf77cccf9b85d3e7dc7fce57093575aa4993b0cce2f2d95f12b53","source_id":"us-ky","stale":false,"prev":"us-ky/krs-405.440","next":"us-ky/krs-405.460"},"notice":"GroundRules: Original legal text.
