{"data":{"id":"us-ky/krs-405.465","jurisdiction":"us-ky","citation":"KRS 405.465","heading":"Income withholding or wage assignments for child support, medical","body":"support, maintenance, and medical support insurance orders.\n(1) This section shall apply only to those child support, medical support, maintenance,\nand medical support insurance orders that are established, modified, or enforced by\nthe Office of the Attorney General or those court orders obtained in administering\nPart D, Title IV of the Federal Social Security Act.\n(2) All child support orders and medical support i nsurance orders being established,\nmodified, or enforced by the Office of the Attorney General, or those orders\nobtained pursuant to the administration of Part D, Title IV of the Federal Social\nSecurity Act, shall provide for income withholding which shall begin immediately.\n(3) The court shall order either or both parents who are obligated to pay child support,\nmedical support, or maintenance under this section to assign to the Office of the\nAttorney General that portion of salary or wages of the parent du e and to be due in\nthe future as will be sufficient to pay the child support amount ordered by the court.\n(4) The order shall be binding upon the employer or any subsequent employer upon the\nservice by certified mail of a copy of the order upon the employe r and until further\norder of the court. The employer may deduct the sum of one dollar ($1) for each\npayment made pursuant to the order.\n(5) The employer shall notify the Office of the Attorney General when an employee,\nfor whom a wage withholding is in eff ect, terminates employment and provide the\nterminated employee's last known address and the name and address of the\nterminated employee's new employer, if known.\n(6) (a) An employer with twenty (20) or more employees shall notify in writing the\nOffice of t he Attorney General, or its designee administering the support\norder, of any lump -sum payment of any kind of one hundred fifty dollars\n($150) or more to be made to an employee under a wage withholding order.\nAn employer with twenty (20) or more employees s hall notify in writing the\nOffice of the Attorney General or its designee no later than forty -five (45)\ndays before the lump-sum payment is to be made or, if the employee's right to\nthe lump-sum payment is determined less than forty-five (45) days before it is\nto be made, the date on which that determination is made. After notification,\nthe employer shall hold each lump -sum payment of one hundred fifty dollars\n($150) or more for thirty (30) days after the date on which it would otherwise\nbe paid to the empl oyee and, on order of the court, pay all or a specified\namount of the lump -sum payment to the Department of Child Support\nServices. The employer may deduct the sum of one dollar ($1) for each\npayment.\n(b) As used in this subsection, \"lump -sum payment of an y kind\" means a lump -\nsum payment of earnings as defined in KRS 427.005.\n(7) Any assignment made pursuant to court order shall have priority as against any\nattachment, execution, or other assignment, unless otherwise ordered by the court.\n(8) No assignment under this section by an employee shall constitute grounds for\ndismissal of the obligor, refusal to employ, or taking disciplinary action against any\nobligor subject to withholding required by this section.","path":["KRS Chapter 405"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56574","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:32Z","sha256":"d88aaeae4e5a9430331fd8b1c25e4c773ad67e2f9d20c82cfd4c04528ea7d3a1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-405.463","next":"us-ky/krs-405.467"},"notice":"GroundRules: Original legal text.
