{"data":{"id":"us-ky/krs-406.021","jurisdiction":"us-ky","citation":"KRS 406.021","heading":"Determination of paternity -- Liability of noncustodial parent.","body":"(1) Paternity may be determined upon the complaint of the mother, putative father,\nchild, person, or agency substantially contributing to the support of the child. The\naction s hall be brought by the county attorney or by the Office of the Attorney\nGeneral or its designee upon the request of complainant authorized by this section.\n(2) Paternity may be determined by the District Court when the mother and father of\nthe child, either:\n(a) Submit affidavits in which the mother states the name and Social Security\nnumber of the child's father and the father admits paternity of the child; or\n(b) Give testimony before the District Court in which the mother states the name\nand Social Secur ity number of the child's father and the father admits\npaternity of the child.\n(3) If paternity has been determined or has been acknowledged according to the laws of\nthis state, the liabilities of the noncustodial parent may be enforced in the same or\nother proceedings by the mother, child, person, or agency substantially contributing\nto the cost of pregnancy, confinement, education, necessary support, or funeral\nexpenses. Bills for testing, pregnancy, and childbirth without requiring third party\nfoundation testimony shall be regarded as prima facie evidence of the amount\nincurred. An action to enforce the liabilities of the noncustodial parent shall be\nbrought by the county attorney upon the request of such complainant authorized by\nthis section. An action to enforce the liabilities of the cost of pregnancy, birthing\ncosts, child support, and medical support shall be brought by the county attorney or\nby the Office of the Attorney General or its designee.\n(4) Voluntary acknowledgment of paternity pursuant to KRS 213.046 shall create a\nrebuttable presumption of paternity.\n(5) Upon a showing of service of process on the defendant and if the defendant has\nmade no pleading to the court or has not moved to enter evidence pursuant to KRS\n406.091, the court shall order paternity to be established by default.","path":["KRS Chapter 406"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56576","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:32Z","sha256":"e473b454e97d30b2409c4a52d8199ef9d0c81306238cd064283ecda3f1b64b68","source_id":"us-ky","stale":false,"prev":"us-ky/krs-406.020","next":"us-ky/krs-406.025"},"notice":"GroundRules: Original legal text.
