{"data":{"id":"us-ky/krs-407.5611","jurisdiction":"us-ky","citation":"KRS 407.5611","heading":"Modification of child support order of another state.","body":"(1) If KRS 407.5613 does not apply, upon petition a tribunal of this state may modify a\nchild support order issued in another state which is registered in this state if, after\nnotice and hearing, the tribunal finds that:\n(a) The following requirements are met:\n1. Neither the child, nor the obligee who is an individual, nor the obligor\nresides in the issuing state;\n2. A petitioner who is a nonresident of this state seeks modification; and\n3. The respondent is subject to the personal jurisdiction of the tribunal of\nthis state; or\n(b) This state is the residence of the child, or a party who is an individual is\nsubject to the personal jurisdiction of the tribunal of this state, and all of the\nparties who are individuals have filed consents in a record in the issuing\ntribunal for a tribunal of this state to modify the support order and assume\ncontinuing, exclusive jurisdiction.\n(2) Modification of a registered child support order is subject to the same requirements,\nprocedures, and defenses that apply to the modificat ion of an order issued by a\ntribunal of this state and the order may be enforced and satisfied in the same\nmanner.\n(3) A tribunal of this state may not modify any aspect of a child support order that may\nnot be modified under the law of the issuing state, including the duration of the\nobligation of support. If two (2) or more tribunals have issued child support orders\nfor the same obligor and same child, the order that controls and shall be so\nrecognized under KRS 407.5207 establishes the aspects of the sup port order which\nare nonmodifiable.\n(4) In a proceeding to modify a child support order, the law of the state that is\ndetermined to have issued the initial controlling order governs the duration of the\nobligation of support. The obligor's fulfillment of th e duty of support established by\nthat order precludes imposition of a further obligation of support by a tribunal of\nthis state.\n(5) On the issuance of an order by a tribunal of this state modifying a child support\norder issued in another state, the tribun al of this state becomes the tribunal having\ncontinuing, exclusive jurisdiction.\n(6) Notwithstanding subsections (1) to (5) of this section and KRS 407.5201(2), a\ntribunal of this state retains jurisdiction to modify an order issued by a tribunal of\nthis state if:\n(a) One (1) party resides in another state; and\n(b) The other party resides outside the United States.","path":["KRS Chapter 407"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44126","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:34Z","sha256":"84ea9617c433ace91528b728b7687445d2bee7ff27bd370994b4d14b46b780aa","source_id":"us-ky","stale":false,"prev":"us-ky/krs-407.5610","next":"us-ky/krs-407.5612"},"notice":"GroundRules: Original legal text.
