{"data":{"id":"us-ky/krs-407.5704","jurisdiction":"us-ky","citation":"KRS 407.5704","heading":"Initiation by Office of the Attorney General of support proceeding under","body":"Convention.\n(1) In a support proceeding under this Article, the Office of the Attorney General shall:\n(a) Transmit and receive applications; and\n(b) Initiate or facilitate the institution of a proceeding regarding an application in\na tribunal of this state.\n(2) The following support proceedings are available to an obligee under the\nConvention:\n(a) Recognition or recognition and enforcement of a foreign support order;\n(b) Enforcement of a support order issued or recognized in this state;\n(c) Establishment of a support order if there is no existing order, including, if\nnecessary, determination of parentage of a child;\n(d) Establishment of a support order if recogn ition of a foreign support order is\nrefused under KRS 407.5708(2)(b), (d), or (i);\n(e) Modification of a support order of a tribunal of this state; and\n(f) Modification of a support order of a tribunal of another state or a foreign\ncountry.\n(3) The following support proceedings are available under the Convention to an obligor\nagainst which there is an existing support order:\n(a) Recognition of an order suspending or limiting enforcement of an existing\nsupport order of a tribunal of this state;\n(b) Modification of a support order of a tribunal of this state; and\n(c) Modification of a support order of a tribunal of another state or a foreign\ncountry.\n(4) A tribunal of this state may not require security, bond, or deposit, however\ndescribed, to guarantee the payment of costs and expenses in proceedings under the\nConvention.","path":["KRS Chapter 407"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54399","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:34Z","sha256":"89bcf6e9abd7a3e984bb228c8f3fded412cbd19e0b1f079453eb3b00304b61f2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-407.5703","next":"us-ky/krs-407.5705"},"notice":"GroundRules: Original legal text.
