{"data":{"id":"us-ky/krs-407.5710","jurisdiction":"us-ky","citation":"KRS 407.5710","heading":"Foreign support agreement.","body":"(1) Except as otherwise provided in subsections (3) and (4) of this section, a tribunal of\nthis state shall recognize and enforce a foreign support agreement registered in this\nstate.\n(2) An application or direct request for recognition and enforcement of a fo reign\nsupport agreement shall be accompanied by:\n(a) A complete text of the foreign support agreement; and\n(b) A record stating that the foreign support agreement is enforceable as an order\nof support in the issuing country.\n(3) A tribunal of this state ma y vacate the registration of a foreign support agreement\nonly if, acting on its own motion, the tribunal finds that recognition and\nenforcement would be manifestly incompatible with public policy.\n(4) In a contest of a foreign support agreement, a tribunal  of this state may refuse\nrecognition and enforcement of the agreement if it finds:\n(a) Recognition and enforcement of the agreement is manifestly incompatible\nwith public policy;\n(b) The agreement was obtained by fraud or falsification;\n(c) The agreement is incompatible with a support order involving the same parties\nand having the same purpose in this state, another state, or a foreign country if\nthe support order is entitled to recognition and enforcement under KRS\n407.5101 to 407.5902 in this state; or\n(d) The record submitted under subsection (2) of this section lacks authenticity or\nintegrity.\n(5) A proceeding for recognition and enforcement of a foreign support agreement shall\nbe suspended during the pendency of a challenge to or appeal of the agreeme nt\nbefore a tribunal of another state or a foreign country.","path":["KRS Chapter 407"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44140","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:34Z","sha256":"8b3914b647e6272f538b534ddf47ada229e473fb35984e861388fe8c5dbe6c51","source_id":"us-ky","stale":false,"prev":"us-ky/krs-407.5709","next":"us-ky/krs-407.5711"},"notice":"GroundRules: Original legal text.
