{"data":{"id":"us-ky/krs-41.305","jurisdiction":"us-ky","citation":"KRS 41.305","heading":"Elder and vulnerable victims trust fund.","body":"(1) The elder and vulnerable victims trust fund is created as a separate revolving fund\nin the Office of the State Treasurer.\n(2) The moneys in the trust fund shall be expended only as provided in this section and\nare hereby appropriated for those purposes.\n(3) The State Treasurer shall credit to the trust fund all amounts received for this\npurpose, including appropriations, grants, gifts, and any amounts received under\nKRS 381.280.\n(4) The State Treasurer shall invest trust fund money in the same manner as sur plus\nfunds are invested. Earnings shall be credited to the trust fund.\n(5) Notwithstanding KRS 45.229, any moneys remaining in the trust fund at the close\nof the fiscal year shall not lapse but shall be carried forward into the succeeding\nfiscal year to be used for the purposes set forth in this section.\n(6) Money shall be disbursed from the trust fund only for the purpose of providing\nfunding to one (1) or more public or private nonprofit organizations, including\ngovernment organizations, in the developmen t or operation of elder or vulnerable\nadult abuse, neglect, or financial exploitation prevention or intervention programs.\nAn organization shall be eligible to receive funding only if:\n(a) The organization agrees to provide at least a twenty -five percent (25%) match\nof the total project amount requested, which may consist of monetary or in -\nkind contributions;\n(b) The organization demonstrates a willingness and ability to provide program\nmodels and consultation to other organizations and communities regardin g\nprogram development and maintenance; and\n(c) The organization funds:\n1. Programs which provide advocacy, crisis counseling, financial\nguardianship, or other similar services to victims of elder or vulnerable\nadult abuse, neglect, or financial exploitation;\n2. Law enforcement, prosecution, or court -based programs that enhance\ncase investigations, prosecutions, or victim assistance in criminal cases\ninvolving elder or vulnerable adult abuse, neglect, or financial\nexploitation;\n3. Programs which develop and implement public education and awareness\ncampaigns on elder and vulnerable adult abuse, neglect, or financial\nexploitation by making use of electronic and print media to inform the\npublic about the nature of these crimes and available resources such as\nvictims' rights, legal remedies, agency services, and prevention\nstrategies; or\n4. Research initiatives that provide greater insight into the dynamics of\nelder and vulnerable adult abuse, neglect, or financial exploitation and\nguidance on best practices for intervention or prevention strategies.\n(7) (a) Fiscal, programmatic, and disbursement authority over trust fund money shall\nbe provided by the Justice and Public Safety Cabinet, which shall develop a\nreview panel system to award grants from the trust fund on an annual basis.\nPanel members shall be individuals with knowledge and operati onal\nexperience in elder and vulnerable adult abuse, neglect, or financial\nexploitation and shall be drawn from the law enforcement, court, prosecution,\nand victim advocacy communities.\n(b) In disbursing money from the trust fund, the panel shall not disbu rse to any\none (1) program more than twenty -five percent (25%) of the total funds\navailable for disbursement and shall seek to distribute meaningful awards to\nas many programs as possible throughout the Commonwealth.\n(8) The Justice and Public Safety Cabin et shall promulgate administrative regulations\nin accordance with KRS Chapter 13A to implement this section.","path":["KRS Chapter 41"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=39693","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:00Z","sha256":"22b199b56e6b64b86067cd38b0201563b20a292f72c94948bb11427e33f021e6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-41.300","next":"us-ky/krs-41.310"},"notice":"GroundRules: Original legal text.
