{"data":{"id":"us-ky/krs-411.187","jurisdiction":"us-ky","citation":"KRS 411.187","heading":"Supersedeas bond to stay execution of judgment granting any relief during","body":"appeal -- Limit -- Rescission of limit if assets diverted or dissipated.\n(1) In any civil action brought under any legal theory, the amount of a supersedeas bond\nnecessary to st ay execution of a judgment granting legal, equitable, or any other\nrelief during the entire course of all appeals or discretionary reviews of the\njudgment by all appellate courts shall be set in accordance with applicable law,\nexcept that the total amount of the supersedeas bonds that are required collectively\nof all appellants during the appeal of a civil action may not exceed one hundred\nmillion dollars ($100,000,000) in the aggregate, regardless of the amount of the\njudgment that is appealed.\n(2) If the appellee proves by a preponderance of the evidence that a party bringing an\nappeal, for whom the supersedeas bond requirement has been limited, is\npurposefully dissipating or diverting assets outside of the ordinary course of its\nbusiness for the purpose o f avoiding ultimate payment of the judgment, the\nlimitation granted under subsection (1) of this section shall be rescinded and a court\nmay require the appellant to post a bond in an amount up to the full amount of the\njudgment pursuant to the Kentucky Rules of Civil Procedure.","path":["KRS Chapter 411"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17785","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:35Z","sha256":"b0172f7c19fcf7e5f9261071b321ac48b4043115be7a171440ada649a6cf99ad","source_id":"us-ky","stale":false,"prev":"us-ky/krs-411.186","next":"us-ky/krs-411.188"},"notice":"GroundRules: Original legal text.
