{"data":{"id":"us-ky/krs-411.212","jurisdiction":"us-ky","citation":"KRS 411.212","heading":"Action for damages caused by falsely reporting an incident -- Liability.","body":"(1) In addition to any restitution ordered by the court under KRS 519.040(4), any\nperson who suffers harm as a result of a violation of KRS 519.040(1)(a) or (e) may\nrecover damages in a civil cause of action against the alleged perpetrator, including\nbut not limited to damages for infliction of emotional distress, compensatory and\npunitive damages, court costs, and reasonable attorney's fees.\n(2) The action may be filed in a court of competent jurisdiction for the county in which\nthe alleged violation occurred or the plaintiff resides.\n(3) An individual found liable under this section shall be jointly and severally liable\nwith each other person, if any, found liable under this section for the damages\narising from the same violation of KRS 519.040.","path":["KRS Chapter 411"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52931","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:35Z","sha256":"dd80f44a0a10a8b3cf707c3f349987f207890bbf2e1f9b91e1aaf3d7a2a7cb62","source_id":"us-ky","stale":false,"prev":"us-ky/krs-411.210","next":"us-ky/krs-411.215"},"notice":"GroundRules: Original legal text.
