{"data":{"id":"us-ky/krs-411.225","jurisdiction":"us-ky","citation":"KRS 411.225","heading":"Employer immunity from civil liability for disclosure of employee","body":"information -- Exceptions -- Effect of provision.\n(1) An employer who provides information about the job performance, professional\nconduct, or evaluation of a former or current employee to a prospective employer of\nthat employee, at the request of that employee or prospective employer, shall be\nimmune from civil liability arising out of the disclosure unless the plaintiff in the\ncivil action proves:\n(a) That the employer disclosed the in formation knowing that it was false, with\nreckless disregard of whether it was true or false, or with intent to mislead the\nprospective employer; or\n(b) That the disclosure of the information by the employer constitutes an unlawful\ndiscriminatory practice under KRS Chapter 344.\n(2) This section does not create a new cause of action or substantive legal right against\nan employer.\n(3) This section does not limit an employer's immunity from civil liability or defenses\nestablished in another section of the Kent ucky Revised Statutes or available at\ncommon law.","path":["KRS Chapter 411"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17792","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:35Z","sha256":"fe239ddb6b25c2b4770b311b471e9561dc9c70fa53614def41ad252ab9669a6a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-411.220","next":"us-ky/krs-411.230"},"notice":"GroundRules: Original legal text.
