{"data":{"id":"us-ky/krs-411.241","jurisdiction":"us-ky","citation":"KRS 411.241","heading":"Immunity from liability for person, gleaner, or representative of nonprofit","body":"organization for donation of apparently wholesome food or apparently fit\ngrocery product made in good faith to a nonprofit organization -- Exception --\nImmunity from liab ility for 501(c)(3) tax -exempt nonprofit or religious\norganization or home-based processor -- Conditions.\n(1) (a) A person, gleaner, or paid or unpaid representative of a nonprofit organization\nshall not be subject to any civil or criminal liability ar ising from the nature,\nage, packaging, or condition of apparently wholesome food or an apparently\nfit grocery product that the person or gleaner donates in good faith to a\nnonprofit organization for ultimate distribution to people, unless the acts\nconstitute intentional misconduct.\n(b) The protection from liability created by this subsection extends to an\napparently wholesome food or apparently fit grocery product bearing a past -\ndate expiration date, sell-by date, use-by date, or other date.\n(2) (a) A nonpr ofit organization or paid or unpaid representative of a nonprofit\norganization shall not be subject to any civil or criminal liability arising from\nthe nature, age, packaging, or condition of apparently wholesome food or an\napparently fit grocery product t hat the nonprofit organization received as a\ndonation in good faith from a person or gleaner for ultimate distribution to\npeople, unless the acts constitute intentional misconduct.\n(b) The protection from liability created by this subsection extends to an\napparently wholesome food or apparently fit grocery product bearing a past -\ndue expiration date, sell-by date, use-by date, or other date.\n(3) A person who allows the collection or gleaning of donations on property owned or\noccupied by the person, by gleane rs or by paid or unpaid representatives of a\nnonprofit organization for ultimate distribution to people, shall not be subject to\ncivil or criminal liability that arises due to the injury or death of the gleaner or\nrepresentative unless the acts constitute intentional misconduct.\n(4) A nonprofit or religious organization that is recognized as tax exempt under Section\n501(c)(3) of the Internal Revenue Code or a home -based processor shall not be\nsubject to any civil or criminal liability arising from the produ ction or donation of\nsafe and apparently wholesome food to a homeless shelter or to individuals\ndisplaced due to a declared natural disaster in accordance with KRS 217.127(4).","path":["KRS Chapter 411"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57270","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:35Z","sha256":"ff0cf7f1b55f6175435dc1a671b717b930e72cda096cc7c559d1d65529c87ed7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-411.240","next":"us-ky/krs-411.242"},"notice":"GroundRules: Original legal text.
