{"data":{"id":"us-ky/krs-411.290","jurisdiction":"us-ky","citation":"KRS 411.290","heading":"Definitions KRS 411.290 to 411.298.","body":"As used in KRS 411.290 to 411.298, unless the context otherwise requires:\n(1) \"Contracting entity\" means the Commonwealth, or any city, county, urban -county\ngovernment, consolidated local government, unified local government, or charter\ncounty government;\n(2) \"Contractor\" means any individual, corporation, limited liability company,\npartnership, or other legal entity, and any subcontractor, director, officer, or\nemployee of the individual or legal entity that contracts with a contracting entity to\nfurnish labor, materials, equipment, and other incidentals necessary for performance\nof work on a project;\n(3) \"Dangerous condition\" means a condition that is not reasonably safe for the\nintended use of the roadway and is capable of causing an individual physical i njury\nor death under the anticipated use of the roadway;\n(4) \"Design professional\" means a licensed professional engineer or other individual or\nentity licensed or permitted under Kentucky law to perform design services that\ncontracts with a contracting entity to provide design services for a project, including\nthe preparation of plans, drawings, and specifications;\n(5) \"Latent defect\" means a defect or omission resulting from the work performed or\nmaterials provided by the contractor under the contract tha t was not discoverable,\nvisible, or apparent;\n(6) \"Project\" means the construction, repair, or maintenance by a contractor of a section\nof highway, road, bridge, or street together with all appurtenances, as specified in a\ncontract with a contracting entity; and\n(7) \"Specifications\" means plans, traffic control requirements, communication\nrequirements, drawings, bid documents, or any other written or electronically stored\nrequirements and details the contractor agrees to perform.","path":["KRS Chapter 411"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57581","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:35Z","sha256":"7399b9fb1ceb155c9eec258a66bba8c792d7489b862f3992b60323710473b1ee","source_id":"us-ky","stale":false,"prev":"us-ky/krs-411.282","next":"us-ky/krs-411.292"},"notice":"GroundRules: Original legal text.
