{"data":{"id":"us-ky/krs-411.296","jurisdiction":"us-ky","citation":"KRS 411.296","heading":"Contractor civil liability limitations.","body":"A contractor shall bear no civil liability for:\n(1) Any alleged property damage, personal injury, death, or other civil claims made by\na noncontractual third party arising from the design decisions or professional\nengineering judgment, including decisions relating to the proper scope or inspection\nof the project, of the contracting entity. This subsection shall not apply when the\ncontractor either:\n(a) Contracts in whole or in part to design the project or to provide professional\nengineering services related to the design of the project; or\n(b) Undertakes to provide design or professional engineering services as to the\nproject; or\n(2) Any dangerous condition that is outside the scope of the project or that is in excess\nof any requirement of the governing pla ns and specifications provided by the\ncontracting entity, except when:\n(a) The contractor contracts to design in whole or in part the project or to provide\nengineering services related to the design of the project; or\n(b) The contractor undertakes to provi de services related to the project that are\noutside the scope of the project or that are in excess of any requirement of the\ngoverning plans and specifications.","path":["KRS Chapter 411"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57584","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:35Z","sha256":"827364742f7d6f706357938e8899ec29ccff42e01fed999540f293c082477324","source_id":"us-ky","stale":false,"prev":"us-ky/krs-411.294","next":"us-ky/krs-411.298"},"notice":"GroundRules: Original legal text.
