{"data":{"id":"us-ky/krs-412.070","jurisdiction":"us-ky","citation":"KRS 412.070","heading":"Compensation of party pressing claims in common interest for others --","body":"Notice to interested persons.\n(1) In actions for the settlement of estates, or for the recovery of money or property held\nin joint tenancy, coparcenary, or as tenants in common, or for the recovery of money\nor property which has been illegally or improperly collected, withheld or converted,\nif one (1) or more of the legatees, devisees, distributees or parties in interest has\nprosecuted for the benefit of others interested with him, and has been to trouble and\nexpense in that connection, the court shall allow him his necessary expenses, and\nhis attorney reasonable compensation for his services, in addition to the costs. This\nallowance shall be paid out of the funds recovered before di stribution. The persons\ninterested shall be given notice of the application for the allowance, provided,\nhowever, that if the court before whom the action is pending should determine that\nit is impracticable and too expensive to notify all of the parties i ndividually, then by\norder of said court, personal notice may be dispensed with and in lieu thereof,\nnotice of the application shall be given by an advertisement pursuant to KRS\nChapter 424.\n(2) The compensation herein provided for shall be authorized in actions now pending as\nwell as actions hereafter instituted; provided, that in actions now pending final\norders and judgments have not been ordered and the fund has not come into actual\nbeing.","path":["KRS Chapter 412"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17843","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:36Z","sha256":"0200ae8328c8f8fa9c5dee6a09f7d9cadd363716107f5a3df68623aec8c9f8c1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-412.060","next":"us-ky/krs-412.080"},"notice":"GroundRules: Original legal text.
