{"data":{"id":"us-ky/krs-413.135","jurisdiction":"us-ky","citation":"KRS 413.135","heading":"Action for damages arising out of injury.","body":"(1) No action to recover damages, whether based upon contract or sounding in tort,\nresulting from or arising out of any deficiency in the construction components,\ndesign, planning, supervision, inspection, or construction of any improvement to\nreal property, o r for any injury to property, either real or personal, arising out of\nsuch deficiency, or for injury to the person or for wrongful death arising out of any\nsuch deficiency, shall be brought against any person after the expiration of seven (7)\nyears following the substantial completion of such improvement.\n(2) Notwithstanding the provisions of subsection (1) of this section, in the case of such\nan injury to property or the person or wrongful death resulting from such injury,\nwhich injury occurred during the seventh year following substantial completion of\nsuch improvement, an action to recover damages for such injury or wrongful death\nmay only be brought within one (1) year from the date upon which such injury\noccurred (irrespective of the date of death), but  in no event may such an action be\nbrought more than eight (8) years after the substantial completion of construction of\nsuch improvement.\n(3) Nothing in this section shall be construed as extending the period prescribed by\nstatute for the bringing of any action for damages.\n(4) As used in this section, the term \"person\" shall mean an individual, corporation,\npartnership, business trust, unincorporated association, or joint stock company; the\nterm \"substantial completion\" shall be construed to mean the date  upon which the\nowner of the structure, project, or facility first entered upon the occupancy or\ncommenced the use thereof.","path":["KRS Chapter 413"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17869","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:36Z","sha256":"9ac34a91e2e1826dadc9596cf1742771170d51b17f77082fbb3e4d35a219dcfe","source_id":"us-ky","stale":false,"prev":"us-ky/krs-413.130","next":"us-ky/krs-413.137"},"notice":"GroundRules: Original legal text.
