{"data":{"id":"us-ky/krs-413.2485","jurisdiction":"us-ky","citation":"KRS 413.2485","heading":"Action relating to injury to or illness of an adult as a result of a","body":"sexual offense.\n(1) As  used  in this section, \"injury or illness\" means  either a physical or\npsychological injury or illness.\n(2) A  civil action for recovery of damages  for an injury or illness suffered as a\nresult of an act or series of acts against a person eighteen (18) years old or\nolder that meets the criteria of KRS  510.040, 510.050, 510.060, 510.070,\n510.080, 510.090, 510.110, 510.120, 510.130, 510.140, 510.150, 529.100\nwhere  the offense involves commercial sexual activity, 529.110 where the\noffense involves commercial sexual activity, 530.020, 531.090, or 531.100,\nshall be brought before whichever of the following periods last expires:\n(a) Within five (5) years of the act or the last of a series of acts by the same\nperpetrator;\n(b) Within five (5) years of the date the victim knew, or should have known, of\nthe act;\n(c) Within five (5) years upon knowledge or identity of the perpetrator; or\n(d) Within five (5) years of the conviction of a civil defendant for KRS\n510.040,  510.050, 510.060, 510.070, 510.080, 510.090, 510.110,\n510.120, 510.130, 510.140, 510.150, 529.100 where the offense involves\ncommercial  sexual activity, 529.110  where  the  offense involves\ncommercial sexual activity, 530.020, 531.090, or 531.100.\n(3) No  prior criminal prosecution or conviction of the civil defendant for the act or\nseries of acts shall be required to bring a civil action under this section for\nredress of an injury or illness.","path":["KRS Chapter 413"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46512","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:36Z","sha256":"8aef9f60c7b589c19cdea855462d6605a6bfc1cb2453905ac3bcef7138a2297c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-413.248","next":"us-ky/krs-413.249"},"notice":"GroundRules: Original legal text.
