{"data":{"id":"us-ky/krs-416.140","jurisdiction":"us-ky","citation":"KRS 416.140","heading":"Companies transmitting or selling electricity, gas, or gasoline may acquire","body":"rights for lines and appliances along roads and streams.\n(1) Subject to the provisions of subsections (2) and (3) of this section, any person\nauthorized under the laws of this  state to conduct the business of producing or\nsupplying water, electricity, gas or gasoline for purposes of light, heat, domestic use\nor power, or who is engaged in the business of the transmission or sale of water,\nelectricity, gas or gasoline for such p urposes, the aforesaid businesses being for a\npublic purpose, may construct and maintain transmission or distribution lines,\nincluding placing and maintenance of pipes, poles, wires, crossarms and all other\nequipment incident thereto, for use in the transm ission and sale of such water,\nelectricity, gas or gasoline under, on, along or over any right -of-way used as a state\nhighway, county road, public way or dedicated road outside the limits of a city, and\nover, under or across any of the waters of this state  outside the limits of a city, and\nmay construct and maintain along any right -of-way used for purposes of such state\nhighway or county road all erections and appliances that are necessary to transform,\nconvert and apply such water, electricity, gas or gaso line to the public purposes of\nlighting, heat, domestic use or power and to distribute and deliver it to the\nconsumers.\n(2) The fixtures of the company shall not interfere with, obstruct or endanger the travel\non and along the highway or road, nor obstruct the navigation of the waters, and the\nlocation of all transmission lines and other appliances shall be subject to the\nreasonable direction and regulation of the authorities having control of the\nhighways, roads and waters through and over which the lines are constructed or\nproposed to be constructed.\n(3) Before any persons named in subsection (1) of this section shall proceed to place his\nwires, poles or other appliances on or over any part of the right -of-way of a state\nhighway, he shall first obtain from  the Department of Highways a permit so to do.\nAny poles, wires or other obstructions, heretofore or hereafter placed along, under,\non or over any state highway that are found by the Department of Highways to be\nunreasonably interfering in any way with the  convenient, safe and continuous use\nand maintenance of such highway shall, upon thirty (30) days' notice to the person\nor his chief agent, by the Department of Highways, be removed or relocated by such\nperson at his own expense, except as otherwise provid ed in KRS 177.035.\nWhenever an order of the Department of Highways requires such removal or change\nin the location of any telephone, telegraph, electric light or other poles, signboards,\nfences, gasoline tanks and pumps, gas, water, sewerage, oil or other pipelines, or\nother similar construction or obstructions from the right -of-way of a state highway,\nand the owner thereof fails to remove or change the same at his own expense,\nexcept as otherwise provided in KRS 177.035, to conform to the order within the\ntime stated in the notice, the Department of Highways shall proceed to cause the\nobstruction to be removed; the expense thereby incurred shall be paid out of any\nmoney available therefor, and shall be charged against the owner and levied and\ncollected and paid into the State Treasury as provided by law.","path":["KRS Chapter 416"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17923","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:37Z","sha256":"5939e3675a32f7b6a8110bb69e22ee4d3781db1fabed47ea9a9d23085458f9ed","source_id":"us-ky","stale":false,"prev":"us-ky/krs-416.130","next":"us-ky/krs-416.150"},"notice":"GroundRules: Original legal text.
