{"data":{"id":"us-ky/krs-416.220","jurisdiction":"us-ky","citation":"KRS 416.220","heading":"Owner of real estate providing public sleeping accommodations and meals","body":"-- Condemnation for water supply -- Furnishing of water to owner of property\ncondemned.\n(1) The owner of real estate serving the public, providing sleeping accommodations and\nmeals, when pure water is not available in adequate quantities, shall have the right\nto condemn on the banks of any navigable stream a tract of land not more than\ntwenty (20) feet square and above the high water mark for a pumping station site\nand a right -of-way for a pipeline from said site to the deep water of the navigable\nstream and from said pumping station site to the point on the owner's real estate\nwhere the water is desired for use. The said property owner may condemn a right -\nof-way for an electric power line over the most direct course to the pumping station\nsite. In the event the owner of such real estate finds it more desirable to make\nconnections with the water system of a municipality or a water supply line leading\nfrom a navigable stream to the municipality or other source of supply, then said real\nestate owner may, at his option, condemn a right -of-way for a pipeline from said\ncity water system or water supply line or other source of supply to the point on the\nowner's real estate where the water is desired for use, including such area as may be\nrequired to install and maintain pumps and meters for said water system and an\nelectric line to conduct power to said pump with necessary electric control lines or\napparatus. The owner of property condemning  right-of-way for a water line under\nthis section, may agree to supply the subject owner a quantity of water in lieu of\ncash compensation for the easement, and such agreement to supply water to the\nsubject property owner shall not be construed to place a b urden on the condemning\nparty to supply water service to others or meet the obligation of a public utility to\nrender water service.\n(2) The provisions of KRS 381.660, 381.670, and 381.680 shall be complied with\nexcept that when the pumping station site and  pipeline are located on cliff land and\ndo not cross any tillable land the pumps and pipe may be located above ground.\n(3) The procedure for condemnation shall be that set forth in the Eminent Domain Act\nof Kentucky.","path":["KRS Chapter 416"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17931","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:37Z","sha256":"0a5425df08b59c1e65dc1cfa44a3bdfa09849741197de48d9e442e41759de535","source_id":"us-ky","stale":false,"prev":"us-ky/krs-416.210","next":"us-ky/krs-416.230"},"notice":"GroundRules: Original legal text.
