{"data":{"id":"us-ky/krs-416.580","jurisdiction":"us-ky","citation":"KRS 416.580","heading":"Commissioners -- Appointment -- Report -- Compensation -- Vacancy --","body":"Majority required -- Eminent domain proceedings.\n(1) (a) The Circuit Court, or in the absence of the Circuit Judge from the county, the\nCircuit Court Clerk, shall appoint as commis sioners three (3) impartial\nhousekeepers of the county who are owners of land. They shall be sworn to\nfaithfully and impartially discharge their duties under this section. The\ncommissioners shall view the land or material sought to be condemned and\naward to the owner or owners such a sum as will fairly represent the reduction\nin the market value of the entire property, all of or a portion of which is sought\nto be condemned, said sum being the difference between the market value of\nthe entire property immedi ately before the taking and the market value of the\nremainder of the property immediately after the taking thereof, together with\nthe fair rental value of any temporary easements sought to be condemned.\nWithin fifteen (15) days from the date of their appoi ntment they shall return a\nwritten report to the office of the Circuit Court, stating the above values in\ntheir award and shall describe in their report the property sought to be\ncondemned. They shall be allowed a reasonable fee which shall be taxed as\ncosts.\n(b) If any person appointed to serve as commissioner fails, refuses or becomes\nincapable of acting, the court, or judge thereof shall forthwith appoint a\nqualified person to fill the vacancy. A majority of the commissioners\nappointed and qualified have the power to act and to make and sign the award\nand report. If a majority of the commissioners do not agree on a decision,\nthree (3) new commissioners shall be appointed by the court on application by\nany of the parties to the action.\n(2) In eminent domai n proceedings instituted pursuant to KRS 99.700 to 99.730, in\ndetermining the market of value blighted or deteriorated property, the\ncommissioners shall consider:\n(a) The estimated cost of repairs necessary to bring the property up to the\nminimum standards of the local housing or nuisance code as determined by an\nindependent appraiser, general building or residential contractor or inspector;\nor\n(b) The cost of demolition of the property, if the commissioners determine that\ndemolition would be the most cost-effective manner of addressing the blighted\nor deteriorated structures on the property.","path":["KRS Chapter 416"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45369","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:37Z","sha256":"27016f40ed89395e8093b71a073028d9f6ca7a3ddc11c6aca10b1feaf63aaed6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-416.570","next":"us-ky/krs-416.590"},"notice":"GroundRules: Original legal text.
