{"data":{"id":"us-ky/krs-416.660","jurisdiction":"us-ky","citation":"KRS 416.660","heading":"Standards for determining compensation -- Changes in value -- Taking","body":"date.\n(1) In all actions for the condemnation of lands under the provisions of KRS 416.540 to\n416.670, except temporary easements, there shall be awarded to the landowners as\ncompensation a sum that will fairly represent the difference between the fair market\nvalue of the entire tract, including improvements existing at the time of the filing of\nthe action, all or a portion of which is sought to be condemned, immediately before\nthe taking and the fair market value of the remainder immediately after the taking,\nincluding in the remainder all rights which the landowner may retain in the lands\nsought to be condemned where less than the fee simple interest is taken, together\nwith the fair rental value of any temporary easements sought to be condemned.\n(2) Any change in the fair market value prior to the date of condemnation which the\ncondemnor or condemnee establishes was substantially due to the general\nknowledge of the imminence of c ondemnation or the construction of the project\nshall be disregarded in determining fair market value. The taking date for valuation\npurposes shall be either the date the condemnor takes the land, or the date of the\ntrial of the issue of just compensation, whichever occurs first.\n(3) The value of agricultural infrastructure improvements, including but not limited to\ndrainage tile, water systems, livestock fencing, and permanent on -farm structures,\nshall be considered in determining the fair market value of p roperty actively used\nfor farm or agricultural purposes.","path":["KRS Chapter 416"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56851","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:37Z","sha256":"123ac3c3ae52fd3ed94ac98a1f2ca969e5841f5db16f0f4429fb6df9970a20a3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-416.650","next":"us-ky/krs-416.670"},"notice":"GroundRules: Original legal text.
