{"data":{"id":"us-ky/krs-416.675","jurisdiction":"us-ky","citation":"KRS 416.675","heading":"Public use required -- No condemnation for indirect benefit -- Exemption.","body":"(1) Every grant of authority contained in the Kentucky Revised Statutes to exercise the\npower of eminent domain shall be subject to the condition that the authority be\nexercised only to effectuate a public use of the condemned property.\n(2) \"Public use\" shall mean the following:\n(a) Ownership of the property by the Commonwealth, a political subdivision of\nthe Commonwealth, or other governmental entity;\n(b) The possession, occupation, or enjoyment of the property as a matter of right\nby the Commonwealth, a political subdivision of the Commonwealth, or other\ngovernmental entity;\n(c) The acquisition and transfer of property for the purpose of eliminating\nblighted areas, slum areas, or substandard and insanitary areas in accordance\nwith KRS Chapter 99;\n(d) The u se of the property for the creation or operation of public utilities or\ncommon carriers; or\n(e) Other use of the property expressly authorized by statute.\n(3) No provision in the law of the Commonwealth shall be construed to authorize the\ncondemnation of p rivate property for transfer to a private owner for the purpose of\neconomic development that benefits the general public only indirectly, such as by\nincreasing the tax base, tax revenues, or employment, or by promoting the general\neconomic health of the co mmunity. However, this provision shall not prohibit the\nsale or lease of property to private entities that occupy an incidental area within a\npublic project or building, provided that no property may be condemned primarily\nfor the purpose of facilitating an incidental private use.\n(4) The exercise of the power of eminent domain for the acquisition of property\nfinanced by state road funds or federal highway funds shall be exempt from the\nprovisions of this section.","path":["KRS Chapter 416"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=17973","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:37Z","sha256":"4547b3ad82eb327b0a1059c09f7c41195f8bfe199cd6bf4cf29ea6fcd6ee9d7f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-416.670","next":"us-ky/krs-416.680"},"notice":"GroundRules: Original legal text.
