{"data":{"id":"us-ky/krs-418.075","jurisdiction":"us-ky","citation":"KRS 418.075","heading":"Necessary parties -- Notice to Attorney General in proceedings and appeals","body":"-- Notice to Legislative Research Commission -- Consent to suit required for\ncertain actions involving legislative branch.\nWhen declaratory relief is sought, all persons shall be made parties who have or claim\nany interest which would be affected by the declaration, and no declaration shall\nprejudice the rights of persons not parties to the proceeding.\n(1) In any proceeding which involves the validity of a statute, the Attorney General of\nthe state shall, before judgment is entered, be served with a copy of the petition, and\nshall be entitled to be heard, and if the ordinance or franchise is alleged to be\nunconstitutional, the Attorney General of the state shall also be served wi th a copy\nof the petition and be entitled to be heard.\n(2) In any appeal to the Kentucky Court of Appeals or Supreme Court or the federal\nappellate courts in any forum which involves the constitutional validity of a statute,\nthe Attorney General shall, before the filing of the appellant's brief, be served with a\ncopy of the pleading, paper, or other documents which initiate the appeal in the\nappellate forum. This notice shall specify the challenged statute and the nature of\nthe alleged constitutional defect.\n(3) The Attorney General shall notify the Legislative Research Commission of:\n(a) The receipt of a petition and the nature of any proceedings involving the\nvalidity of a statute; and\n(b) The entering of a final judgment in those proceedings, if the Attor ney General\nis a party to that action.\n(4) Pursuant to Sections 43 and 231 of the Constitution of Kentucky, members of the\nGeneral Assembly, organizations within the legislative branch of state government,\nor officers or employees of the legislative branch  shall not be made parties to any\naction challenging the constitutionality or validity of any statute or regulation,\nwithout the consent of the member, organization, or officer or employee.","path":["KRS Chapter 418"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=18023","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:38Z","sha256":"42c1246cbfa9f3a2a880b779fed230a0387334e1d9d9817cdef64a0dd6237e0c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-418.070","next":"us-ky/krs-418.080"},"notice":"GroundRules: Original legal text.
