{"data":{"id":"us-ky/krs-42.0146","jurisdiction":"us-ky","citation":"KRS 42.0146","heading":"Office of Equal Employment Opportunity and Contract Compliance --","body":"Oversight of certification program for disabled veteran -owned businesses --\nAdministrative regulations.\n(1) For purposes of this section:\n(a) \"Disabled veteran\" means an individual, d omiciled in Kentucky, who has\nserved on active duty in the Armed Forces, has been separated therefrom\nunder honorable or general conditions, and has established the present\nexistence of a service -connected disability or is receiving compensation,\ndisability retirements benefits, or pension because of a public statute\nadministered by the United States Department of Veterans Affairs or\nDepartment of Defense, or was terminated from active duty by the Department\nof Defense because of a disability; and\n(b) \"Disabled veteran-owned business\" means a business:\n1. Where a disabled veteran has at least fifty-one percent (51%) ownership;\n2. That is independently owned and operated;\n3. That does not exceed the applicable size standards for its industry, as\ndetermined by the United States Small Business Administration;\n4. That has been owned and operated by the disabled veteran for at least a\nfull calendar or fiscal year; and\n5. For which the disabled veteran has filed a business tax return consisting\nof a full calendar or fiscal year.\n(2) The Office of Equal Employment Opportunity and Contract Compliance shall\noversee a program that provides certification of a disabled veteran -owned business\nin order to encourage growth among businesses owned by disabled veterans within\nthe state and assist those businesses in competing for work in other states that\nrequire certification by a statewide body. This certification does not provide a\npreference in state procurement, nor does it create a point system or set aside for\ndisabled veteran-owned businesses.\n(3) In order to apply for certification, a disabled veteran shall provide proof of his or\nher disability. Proof shall be in the form of Department of Defense Form DD 214,\nUnited States Department of Veterans Affairs disability lette r, or other United\nStates Department of Veterans Affairs documentation establishing a service -\nconnected disability.\n(4) The Finance and Administration Cabinet shall promulgate any administrative\nregulations necessary to create and manage the disabled veter an-owned business\ncertification program, which may include but is not limited to additional\ncertification requirements, the application process, onsite visitation by the Office of\nEqual Employment Opportunity and Contract Compliance, and recertification.","path":["KRS Chapter 42"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45229","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:01Z","sha256":"cfe2adce44bd9fa814769954df8fcb6563f84c183af1742dc47cc0434d5646ac","source_id":"us-ky","stale":false,"prev":"us-ky/krs-42.0145","next":"us-ky/krs-42.0147"},"notice":"GroundRules: Original legal text.
