{"data":{"id":"us-ky/krs-42.032","jurisdiction":"us-ky","citation":"KRS 42.032","heading":"Web site to provide public access to expenditure records of executive","body":"branch -- Monthly and weekly updates -- Cabinet is sole custodian of\ninformation and records -- Branches to share software and applications.\n(1) By January 1, 2012, the Finance and A dministration Cabinet shall provide public\naccess to records relating to expenditures of the executive branch of state\ngovernment through display of the records on a Web site. The Web site shall\nprovide:\n(a) Financial information of expenditures not exempt under the provisions of state\nor federal law, including:\n1. The payee name;\n2. The category or type of the expenditure;\n3. A description of the reason for the expenditure, if available;\n4. The expenditure amount; and\n5. A link to the financial document, i f the document is electronically\navailable;\n(b) A searchable format;\n(c) Access to the current enacted Executive Branch Budget; and\n(d) A link to the public access Web site displays of the legislative and judicial\nbranches of state government, and of the p ublic institutions of higher\neducation.\n(2) Information on the Web site shall be updated at least on a monthly basis. However,\ninformation on the Web site which is part of, or contained in, an electronic\naccounting system utilized by all branches of state government, such as the\nEnhanced Management Administrative Reporting System (EMARS), shall be\nupdated on a weekly basis.\n(3) The cabinet shall maintain exclusive control and be considered the sole custodian of\nall information and records generated by and t hrough activity of the executive\nbranch of government, notwithstanding the situs of the information and the records\nin another branch of government, and disclosure thereof shall only be by the cabinet\nin accordance with applicable law.\n(4) In order to reduce Web site development costs and enhance public access and use of\nrecords viewed through Web sites as provided by this section and KRS 7.505 and\n26A.260, each branch of state government shall freely share with the other branches\nof state government the software, software developments, and all applications, data,\nand information within its control used for Web site design, appearance, content,\nand operation in compliance with, or in furtherance of, the purposes contemplated\nby this section and KRS 7.505 and 26A.260.","path":["KRS Chapter 42"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=39926","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:01Z","sha256":"30abf1b2b308ec524e367876f0fd3053b78e5f58554c106071c105b791250d5f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-42.030","next":"us-ky/krs-42.035"},"notice":"GroundRules: Original legal text.
