{"data":{"id":"us-ky/krs-42.320","jurisdiction":"us-ky","citation":"KRS 42.320","heading":"Court cost distribution fund -- Disbursements -- Payments into general","body":"fund.\n(1) There is hereby established the court cost distribution fund, which is created to\nprovide a central account into which the court costs collected by all circuit clerks ,\nunder KRS 23A.205(1) and 24A.175(1), shall be paid.\n(2) The fund shall be administered by the Finance and Administration Cabinet, which\nshall make monthly disbursements from the fund according to the following\nschedule:\n(a) Forty-nine percent (49%) of ea ch court cost shall be paid into the general\nfund;\n(b) Ten and eight -tenths percent (10.8%) of each court cost, up to five million\nfour hundred thousand dollars ($5,400,000), shall be paid into the State\nTreasury for the benefit and use of the Kentucky Loc al Correctional Facilities\nConstruction Authority under KRS 441.605 to 441.695;\n(c) Six and one -half percent (6.5%) of each court cost, up to three million two\nhundred fifty thousand dollars ($3,250,000), shall be paid into the spinal cord\nand head injury research trust fund created in KRS 211.504;\n(d) Five and one -half percent (5.5%) of each court cost, up to two million seven\nhundred fifty thousand dollars ($2,750,000), shall be paid into the traumatic\nbrain injury trust fund created in KRS 211.476;\n(e) Five percent (5%) of each court cost, up to two million five hundred thousand\ndollars ($2,500,000), shall be paid into a trust and agency account with the\nAdministrative Office of the Courts and is to be used by the circuit clerks to\nhire additional deputy clerks and to enhance deputy clerk salaries;\n(f) Three and one-half percent (3.5%) of each court cost, up to one million seven\nhundred fifty thousand dollars ($1,750,000), shall be paid to a special trust\nand agency account that shall not lapse for the Dep artment of Public\nAdvocacy;\n(g) Three and four -tenths percent (3.4%) of each court cost, up to one million\nseven hundred thousand dollars ($1,700,000), shall be paid into the crime\nvictims' compensation fund created in KRS 49.480;\n(h) Seven-tenths of one p ercent (0.7%) of each court cost, up to three hundred\nfifty thousand dollars ($350,000), shall be paid to the Justice and Public\nSafety Cabinet to defray the costs of conducting record checks on prospective\nfirearms purchasers pursuant to the Brady Handgun  Violence Prevention Act\nand for the collection, testing, and storing of DNA samples;\n(i) Ten and one-tenth percent (10.1%) of each court cost, up to five million fifty\nthousand dollars ($5,050,000), deposited in the fund shall be paid to the\ncounty sheriff in the county from which the court cost was received; and\n(j) Five and one -half percent (5.5%) of each court cost, up to two million seven\nhundred fifty thousand dollars ($2,750,000), deposited in the fund shall be\npaid to the county treasurer in the county from which the court cost was\nreceived and shall be used by the fiscal court in that c ounty for the purposes\nof defraying the costs of operation of the county jail and the transportation of\nprisoners.\n(3) Any moneys remaining in the fund after the monthly disbursements in subsection\n(2) of this section shall be paid into the general fund.\n(4) Any moneys collected above the prescribed amount shall be paid into the general\nfund.","path":["KRS Chapter 42"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46881","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:02Z","sha256":"a3055847b4cc94b9098641b407cf2f5849c08748aa86c0ebd128ec08c405b6bb","source_id":"us-ky","stale":false,"prev":"us-ky/krs-42.310","next":"us-ky/krs-42.325"},"notice":"GroundRules: Original legal text.
