{"data":{"id":"us-ky/krs-42.560","jurisdiction":"us-ky","citation":"KRS 42.560","heading":"Energy assistance trust fund -- Allocation of interest.","body":"(1) There is established in the Treasury of the Commonwealth a trust fund to be known\nas the \"Energy Assistance Trust Fund\" referred to in KRS 42.560 to 42.572 as the\n\"trust fund.\"\n(2) The trust fund shall consist of any oil overcharge refunds which become available to\nthe state as a result of litigation for alleged overcharges for crude oil or refined\npetroleum products sold during the period of time in which federal price controls on\nsuch products were in effect, any moneys as may be appropriated by the gener al\nfund, and any investment interest earned on the fund.\n(3) The fund shall be managed by the state Office of Financial Management within the\nOffice of the Controller and all moneys in excess of the amount to be disbursed in a\ngiven fiscal year shall be in vested to maximize returns. The principal and any\ninterest earnings of the trust fund shall at no time lapse to the general fund.\n(4) The accumulated interest shall be made available as follows:\n(a) Fifty percent (50%) to the Finance and Administration Cab inet to be allocated\nto weatherization services to low-income households; and\n(b) Fifty percent (50%) to the Cabinet for Health and Family Services to be\nallocated to low-income energy assistance services.\nThe funds to be available for expenditure in any fiscal year shall be appropriated by\nthe General Assembly from the trust fund as provided in KRS 48.300.","path":["KRS Chapter 42"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40932","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:02Z","sha256":"7639147b6628d36529795b9cc764e9cbb562f2442e872e9df433d321b6758e23","source_id":"us-ky","stale":false,"prev":"us-ky/krs-42.555","next":"us-ky/krs-42.562"},"notice":"GroundRules: Original legal text.
