{"data":{"id":"us-ky/krs-42.566","jurisdiction":"us-ky","citation":"KRS 42.566","heading":"Energy assistance trust fund -- Allocation of appropriations.","body":"The funds appropriated by the General Assembly from the energy assistance trust fund\nshall be expended in a manner consistent with the judgments and settlements, as\namended, which produced the oil overcharge refunds, as follows:\n(1) The sum of five hundred  thousand dollars ($500,000) or eight percent (8%) of the\namount appropriated each fiscal year, whichever is greater, shall be distributed\nannually to the Energy and Environment Cabinet for expenditure in the Institutional\nConservation Program established pursuant to Part G of Title III of the Energy\nPolicy and Conservation Act, 42 U.S.C. secs. 6371 et seq. The source of these funds\nshall be deemed to be the trust funds produced by the Stripper Well litigation, In Re\nDepartment of Energy Stripper Well Exemp tion Litigation, D.C. Kan., M.D.L. No.\n378, and the Diamond Shamrock litigation, Diamond Shamrock Refining Co. v.\nStandard Oil of Indiana, D.C. Ind., Civil Action No. C -84-1432, and interest\naccumulated thereon; and\n(2) The balance of the trust funds appro priated for expenditure in any fiscal year shall\nbe distributed as follows:\n(a) Forty percent (40%) to the Finance and Administration Cabinet to be allocated\nto the cabinet's program for weatherization of low -income households\nestablished pursuant to Part A of the Energy Conservation and Existing\nBuildings Act of 1976, 42 U.S.C. secs. 6861 et seq.; and\n(b) Sixty percent (60%) to the Cabinet for Health and Family Services to be\nallocated to the cabinet's program for energy crisis or prevention services for\nlow-income households established pursuant to the Low -Income Home\nEnergy Assistance Act of 1981, 42 U.S.C. secs. 8621 et seq.","path":["KRS Chapter 42"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40933","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:02Z","sha256":"a7eae05cf9a643eebb55577d5739807b8f677792a1d2df7fbd0b34483091a97f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-42.564","next":"us-ky/krs-42.568"},"notice":"GroundRules: Original legal text.
