{"data":{"id":"us-ky/krs-42.738","jurisdiction":"us-ky","citation":"KRS 42.738","heading":"Statewide public safety interoperability plan -- Annual report by executive","body":"director -- Duties of Kentucky Wireless Interoperability Executive Committee -\n- Membership -- Public Safety Working Group.\n(1) The executive director shall establish  and implement a statewide public safety\ninteroperability plan. This plan shall include the development of required\narchitecture and standards that will insure that new or upgraded Commonwealth\npublic safety communications systems will interoperate. The Ke ntucky Wireless\nInteroperability Executive Committee shall be responsible for the evaluation and\nrecommendation of all wireless communications architecture, standards, and\nstrategies. The executive director shall provide direction, stewardship, leadership,\nand general oversight of information technology and information resources. The\nexecutive director shall report by September 15 annually to the Interim Joint\nCommittee on Seniors, Veterans, Military Affairs, and Public Protection and the\nInterim Joint Committee on State Government on progress and activity by agencies\nof the Commonwealth to comply with standards to achieve public safety\ncommunications interoperability.\n(2) The Kentucky Wireless Interoperability Executive Committee shall serve as the\nadvisory body for all wireless communications strategies presented by agencies of\nthe Commonwealth and local governments. All state agencies in the\nCommonwealth shall present all project plans for primary wireless public safety\nvoice or data communications systems  for review and recommendation by the\ncommittee, and the committee shall forward the plans to the executive director for\nfinal approval. Local government entities shall present project plans for primary\nwireless public safety voice or data communications s ystems for review and\nrecommendation by the Kentucky Wireless Interoperability Executive Committee.\n(3) The committee shall develop funding and support plans that provide for the\nmaintenance of and technological upgrades to the public safety shared\ninfrastructure, and shall make recommendations to the executive director, the\nGovernor's Office for Policy and Management, and the General Assembly.\n(4) The executive director shall examine the project plans for primary wireless public\nsafety voice or data commun ications systems of state agencies as required by\nsubsection (2) of this section, and shall determine whether they meet the required\narchitecture and standards for primary wireless public safety voice or data\ncommunications systems.\n(5) The Kentucky Wirele ss Interoperability Executive Committee shall consist of\ntwenty (20) members as follows:\n(a) A person knowledgeable in the field of wireless communications appointed by\nthe executive director who shall serve as chair;\n(b) The executive director of the Offi ce of Infrastructure Services,\nCommonwealth Office of Technology;\n(c) The executive director of Kentucky Educational Television, or the executive\ndirector's designee;\n(d) The information technology lead of the Transportation Cabinet;\n(e) The information technology lead of the Justice and Public Safety Cabinet;\n(f) The information technology lead of the Department of Kentucky State Police;\n(g) The commissioner of the Department of Fish and Wildlife Resources, or the\ncommissioner's designee;\n(h) The information technology lead of the Energy and Environment Cabinet;\n(i) The director of the Division of Emergency Management, Department of\nMilitary Affairs;\n(j) The executive director of the Kentucky Office of Homeland Security;\n(k) The information technology lead of the Department for Public Health, Cabinet\nfor Health and Family Services;\n(l) A representative from an institution of postsecondary education appointed by\nthe Governor from a list of three (3) names submitted by the presi dent of the\nCouncil on Postsecondary Education;\n(m) The executive director of the Center for Rural Development, or the executive\ndirector's designee;\n(n) A representative from a municipal government to be appointed by the\nGovernor from a list of three (3) names submitted by the Kentucky League of\nCities;\n(o) A representative from a county government to be appointed by the Governor\nfrom a list of three (3) names submitted by the Kentucky Association of\nCounties;\n(p) A representative from a municipal police d epartment to be appointed by the\nGovernor from a list of three (3) names submitted by the Kentucky\nAssociation of Chiefs of Police;\n(q) A representative from a local fire department to be appointed by the Governor\nfrom a list of three (3) names submitted b y the Kentucky Association of Fire\nChiefs;\n(r) A representative from a county sheriff's department to be appointed by the\nGovernor from a list of three (3) names submitted by the Kentucky Sheriffs'\nAssociation;\n(s) A representative from a local Emergency M edical Services agency to be\nappointed by the Governor from a list of three (3) names submitted by the\nKentucky Board of Emergency Medical Services; and\n(t) A representative from a local 911 dispatch center to be appointed by the\nGovernor from a list of three (3) names submitted by the Kentucky Chapter of\nthe National Emergency Number Association/Association of Public Safety\nCommunications Officials.\n(6) Appointed members of the committee shall serve for a two (2) year term. Members\nwho serve by virtue of a n office shall serve on the committee while they hold that\noffice.\n(7) The committee shall meet quarterly, or as often as necessary for the conduct of its\nbusiness. A majority of the members shall constitute a quorum for the transaction of\nbusiness. Members' designees shall have voting privileges at committee meetings.\n(8) The committee shall be attached to the Commonwealth Office of Technology for\nadministrative purposes only. Members shall not be paid and shall not be\nreimbursed for travel expenses.\n(9) The Public Safety Working Group is hereby created for the primary purpose of\nfostering cooperation, planning, and development of the public safety frequency\nspectrum as regulated by the Federal Communications Commission, including the\n700 MHz public safety band. The group shall endeavor to bring about a seamless,\ncoordinated, and integrated public safety communications network for the safe,\neffective, and efficient protection of life and property. The Public Safety Working\nGroup membership and other working group memberships deemed necessary shall\nbe appointed by the chair of the Kentucky Wireless Interoperability Executive\nCommittee.\n(10) The committee may establish additional working groups as determined by the\ncommittee.","path":["KRS Chapter 42"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51097","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:03Z","sha256":"d4deeb80ed52d2698486915af339e827148f85e6e675933c7876cdeffd85491c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-42.736","next":"us-ky/krs-42.740"},"notice":"GroundRules: Original legal text.
