{"data":{"id":"us-ky/krs-42.740","jurisdiction":"us-ky","citation":"KRS 42.740","heading":"Geographic Information Advisory Council -- Purpose -- Members --","body":"Conflicts of interest.\n(1) There is hereby established a Geographic Information Advisory Council, attached\nto the Commonwealth Office of Technology for administrative pur poses, to advise\nthe executive director of the Commonwealth Office of Technology on issues\nrelating to geographic information and geographic information systems.\n(2) The council shall recommend policies and procedures that assist state and local\njurisdictions in developing, deploying, and leveraging geographic information\nresources and geographic information systems technology for the purpose of\nimproving public administration.\n(3) The council shall closely coordinate with users of geographic information sy stems\nto recommend policies and procedures that ensure the maximum use of geographic\ninformation by minimizing the redundancy of geographic information and\ngeographic information resources, as well as to ensure that the geographic\ninformation clearinghouse  maintained by the Division of Geographic Information\nSystems meets the needs of all state agencies.\n(4) (a) The Geographic Information Advisory Council shall consist of twenty -five\n(25) members and one (1) legislative liaison. The members shall be\nknowledgeable in the use and application of geographic information systems\ntechnology and shall have sufficient authority within their organizations to\ninfluence the implementation of council recommendations.\n(b) The council shall consist of:\n1. The secretary of the Transportation Cabinet or his or her designee;\n2. The secretary of the Cabinet for Health and Family Services or his or\nher designee;\n3. The director of the Kentucky Geological Survey or his or her designee;\n4. The secretary of the Finance and Administration Cabinet or his or her\ndesignee;\n5. The executive director of the Commonwealth Office of Technology or\nher or his designee, who shall serve as chair;\n6. The secretary of the Economic Development Cabinet or his or her\ndesignee;\n7. The commissioner of the Department for Local Government or his or\nher designee;\n8. The secretary of the Justice and Public Safety Cabinet or his or her\ndesignee;\n9. One (1) member appointed by the Governor from a list of three (3)\npersons submitted by the president of the Council on Postsecondary\nEducation;\n10. The adjutant general of the Department of Military Affairs or his or her\ndesignee;\n11. The commissioner of the Department of Education or his or her\ndesignee;\n12. The secretary of the Energy and Environment Cabinet or his or her\ndesignee;\n13. The Commissioner of the Department of Agriculture or his or her\ndesignee;\n14. The secretary of the Tourism, Arts and Heritage Cabinet or his or her\ndesignee;\n15. The executive director of the Office of Property Valuation or his or her\ndesignee;\n16. One (1) member appointed by the Governor from a list of three (3)\npersons submitted by the president of the Kentucky League of Cities;\n17. One (1) member appointed by the Governor from a list of three (3)\npersons submitted by the president of the Kentucky Association of\nCounties;\n18. One (1) member appointed by the Governor from a list of three (3)\npersons submitted by the pres ident of the Kentucky Chapter of the\nAmerican Planning Association;\n19. One (1) member appointed by the Governor from a list of three (3)\npersons submitted by the president of the Kentucky Association of\nProfessional Surveyors;\n20. One (1) member appointed  by the Governor from a list of three (3)\npersons submitted by the president of the Kentucky Society of\nProfessional Engineers;\n21. One (1) member appointed by the Governor from a list of three (3)\npersons submitted by the chairman of the Kentucky Board of  Registered\nGeologists;\n22. One (1) member appointed by the Governor from a list of three (3)\npersons submitted by the president of the Council of Area Development\nDistricts;\n23. One (1) member appointed by the Governor from a list of three (3)\npersons sub mitted by the president of the Kentucky Association of\nMapping Professionals;\n24. One (1) member appointed by the Governor from a list of three (3)\npersons submitted by the executive director of the Kentucky Property\nValuation Administrators Association; and\n25. The executive director of the Kentucky Office of Homeland Security.\n(c) The council shall have one (1) nonvoting legislative liaison, to be appointed\nby the Legislative Research Commission.\n(5) The council may have committees and subcommittees as d etermined by the council\nor an executive committee, if an executive committee exists.\n(6) A member of the council shall not:\n(a) Be an officer, employee, or paid consultant of a business entity that has, or of\na trade association for business entities that  have, a substantial interest in the\ngeographic information industry and is doing business in the Commonwealth;\n(b) Own, control, or have, directly or indirectly, more than ten percent (10%)\ninterest in a business entity that has a substantial interest in the geographic\ninformation industry;\n(c) Be in any manner connected with any contract or bid for furnishing any\ngovernmental body of the Commonwealth with geographic information\nsystems, the computers on which they are automated, or a service related to\ngeographic information systems;\n(d) Be a person required to register as a lobbyist because of activities for\ncompensation on behalf of a business entity that has, or on behalf of a trade\nassociation of business entities that have, substantial interest in the geographic\ninformation industry;\n(e) Accept or receive money or another thing of value from an individual, firm, or\ncorporation to whom a contract may be awarded, directly or indirectly, by\nrebate, gift, or otherwise; or\n(f) Be liable to civil action or any action performed in good faith in the\nperformance of duties as a council member.\n(7) Those council members specif ied in subsection (4)(b) of this section who serve by\nvirtue of an office shall serve on the board while they hold that office.\n(8) Appointed members of the council shall serve for a term of four (4) years.\nVacancies in the membership of the council shall be filled in the same manner as\nthe original appointments. If a nominating organization changes its name, its\nsuccessor organization having the same responsibilities and purposes shall be the\nnominating organization.\n(9) The council shall have no funds of its own, and council members shall not receive\ncompensation of any kind from the council.\n(10) A majority of the members shall constitute a quorum for the transaction of business.\nMembers' designees shall have voting privileges at council meetings.","path":["KRS Chapter 42"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57639","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:03Z","sha256":"940dab011faa2c73b7cdfa8f61a48a29e4696a6cc13bf170d94c55e4d435c9e5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-42.738","next":"us-ky/krs-42.742"},"notice":"GroundRules: Original legal text.
