{"data":{"id":"us-ky/krs-421.360","jurisdiction":"us-ky","citation":"KRS 421.360","heading":"Uniform Interstate Depositions and Discovery Act.","body":"(1) This section may be cited as the Uniform Interstate Depositions and Discovery Act.\n(2) As used in this section:\n(a) \"Foreign jurisdiction\" means a state other than this state;\n(b) \"Foreign subpoena\" means a subpoena issued under authority of a court of\nrecord of a foreign jurisdiction;\n(c) \"Person\" means an individual, corporation, business trust, estate, trust,\npartnership, limited liability company, association, joint venture, public\ncorporation, government, or governmental subdivision, agency, or\ninstrumentality, or any other legal or commercial entity;\n(d) \"State\" means a state of the United States, the District of Columbia, Puerto\nRico, the United States Virgin Islands, a federally recognized Indian tribe, or\nany territory or insular possession subject to the jurisdiction of the United\nStates; and\n(e) \"Subpoena\" means a document, however denominated, issued under authority\nof a court of record requiring a person to:\n1. Attend and give testimony at a deposition;\n2. Produce and permit inspection and copyin g of designated books,\ndocuments, records, electronically stored information, or tangible things\nin the possession, custody, or control of the person; or\n3. Permit inspection of premises under the control of the person.\n(3) (a) To request issuance of a sub poena under this section, a party shall submit a\nforeign subpoena to the clerk of the Circuit Court of the county in which\ndiscovery is sought to be conducted in this state. A request for the issuance of\na subpoena under this section does not constitute an  appearance in the courts\nof this state.\n(b) When a party submits a foreign subpoena to a clerk of the Circuit Court in this\nstate, the clerk, in accordance with that court's procedure, shall promptly issue\na subpoena for service upon the person to which the foreign subpoena is\ndirected.\n(c) A subpoena under paragraph (b) of this subsection shall:\n1. Incorporate the terms used in the foreign subpoena; and\n2. Contain or be accompanied by the names, addresses, and telephone\nnumbers of all counsel of record in the proceeding to which the\nsubpoena relates and of any party not represented by counsel.\n(4) A subpoena issued by a clerk of the Circuit Court under subsection (3) of this\nsection shall be served in compliance with any rule of court or statute relating to the\nservice of a subpoena issued in this state.\n(5) Rules of court and any provision of the Kentucky Revised Statutes applicable to\ncompliance with subpoenas to attend and give testimony; produce designated books,\ndocuments, records, electronically stored information, or tangible things; or permit\ninspection of premises shall apply to subpoenas issued under subsection (3) of this\nsection.\n(6) An application to the court for a protective order or to enforce, quash, or modify a\nsubpoena issued by a clerk of the Circuit Court under subsection (3) of th is section\nshall comply with the rules of court of this state and statutes of this state and be\nsubmitted to the Circuit Court in the county in which discovery is to be conducted.\n(7) In applying and construing this uniform act, consideration shall be given to the need\nto promote uniformity of the law with respect to its subject matter among states that\nenact it.\n(8) This section applies to requests for discovery in cases pending on July 15, 2008.","path":["KRS Chapter 421"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=18075","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:39Z","sha256":"d95a2f9630bb605b4c2ecc9bfdd5ba6a368b70adc1f1e39f82b0385ba390698e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-421.355","next":"us-ky/krs-421.500"},"notice":"GroundRules: Original legal text.
