{"data":{"id":"us-ky/krs-422.310","jurisdiction":"us-ky","citation":"KRS 422.310","heading":"Personal attendance of custodian of hospital records, when.","body":"The personal attendance of the employee of the hospital charged with the responsibility of\nbeing custodian of the original charts or records specified in the subpoena shall be\nrequired if the records pertain to a patient treated by a psychiatrist and the hospital has not\nreceived within the thirty (30) days preceding service of the subpoena an authorization\nsigned by the patient or his legal guardian permitting the contents of the records to be\nreleased. If personal attendance of a witness is required for t he reason provided in this\nsection, the hospital may nevertheless elect to substitute true, legible and durable copies\nof the charts or records specified in the subpoena duces tecum by the giving of a written\nnotice of such election, in which case payment to the hospital of the actual and reasonable\nexpenses of duplication of such charts or records by any party to the proceeding in which\nthe subpoena was issued, or such party's attorney of record, shall be a condition precedent\nto the personal attendance of  any person pursuant to the subpoena, unless otherwise\nordered by the court or other body before which said action or proceeding is pending.","path":["KRS Chapter 422"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=18143","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:39Z","sha256":"a0655ca35266b6e62a5fdfc958439bd2edbd72be7835d2e31b07ffb0c3cd797c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-422.305","next":"us-ky/krs-422.315"},"notice":"GroundRules: Original legal text.
