{"data":{"id":"us-ky/krs-423.340","jurisdiction":"us-ky","citation":"KRS 423.340","heading":"Who may perform notarial act -- Effect of signature and title -- Powers of","body":"county clerk.\n(1) A notarial act may be performed in this state by:\n(a) A notary public of this state; or\n(b) A county clerk of this state.\n(2) The signature and title o f an individual performing a notarial act in this state are\nprima facie evidence that the signature is genuine and that the individual holds the\ndesignated title.\n(3) The signature and title of a notarial officer described in this section conclusively\nestablishes the authority of the notarial officer to perform the notarial act.\n(4) A county clerk shall have the powers of a notarial officer in the exercise of the\nofficial functions of the office of clerk within his or her county, and the official\nactions of  the county clerk shall not require the witness or signature of a notary\npublic.","path":["KRS Chapter 423"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49497","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:41Z","sha256":"695190bfe22733735a1892f66cf888ea3bf57e1a53556edfc1077a64148ca74c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-423.335","next":"us-ky/krs-423.345"},"notice":"GroundRules: Original legal text.
