{"data":{"id":"us-ky/krs-423.345","jurisdiction":"us-ky","citation":"KRS 423.345","heading":"Effect of notarial act performed in another state, under authority of tribe,","body":"or under authority of federal law.\n(1) (a) A notarial act performed in another state has the same effect under the law of\nthis state as if performed by a notarial officer of this state, if the act performed\nin that state is performed by:\n1. A notary public of that state;\n2. A judge, clerk, or deputy clerk of a court of that state; or\n3. Any other individual authorized by the law of that state to perform the\nnotarial act.\n(b) The signature and title of an individual performing a notarial act in another\nstate are prima facie evidence that the signature is genuine and that the\nindividual holds the designated title.\n(c) The signature and title of a notarial officer described in paragraph (a) or (b) of\nthis subsection conclusively establish the authority of the officer to perform\nthe notarial act.\n(2) (a) A notarial act performed in another state has the same effect under the law of\nthis state if the act performed is:\n1. By a notary public of this state; and\n2. In a civil action or legal proceeding originating in this state.\n(b) The signature and title of an individual performing a notarial act in another\nstate are prima facie evidence that the signature is genuine and that the\nindividual holds the designated title.\n(c) The signature and title of a notarial officer described in paragraph (a) or (b) of\nthis subsection shall conclusively establish the authority of the officer to\nperform the notarial act.\n(3) (a) A notarial act performed under the authority and in the jurisdiction of a\nfederally recognized Indian tribe has the same ef fect as if performed by a\nnotarial officer of this state, if the act performed in the jurisdiction of the tribe\nis performed by:\n1. A notary public of the tribe;\n2. A judge, clerk, or deputy clerk of a court of the tribe; or\n3. Any other individual authori zed by the law of the tribe to perform the\nnotarial act.\n(b) The signature and title of an individual performing a notarial act under the\nauthority and in the jurisdiction of a federally recognized Indian tribe are\nprima facie evidence that the signature is genuine and that the individual holds\nthe designated title.\n(c) The signature and title of a notarial officer described in paragraph (a) or (b) of\nthis subsection conclusively establish the authority of the notarial officer to\nperform the notarial act.\n(4) (a) A notarial act performed under the authority of federal law has the same effect\nunder the law of this state as if performed by a notarial officer of this state, if\nthe act performed under federal law is performed by:\n1. A judge, clerk, or deputy clerk of a court;\n2. An individual in military service or performing duties under the\nauthority of military service who is authorized to perform notarial acts\nunder federal law;\n3. An individual designated a notarizing officer by the United States\nDepartment of State for performing notarial acts overseas; or\n4. Any other individual authorized by federal law to perform the notarial\nact.\n(b) The signature and title of an individual acting under federal authority and\nperforming a notarial act are prima facie evidence that the signature is genuine\nand that the individual holds the designated title.\n(c) The signature and title of an officer described in paragraph (a) or (b) of this\nsubsection conclusively establish the authority of the officer to perform the\nnotarial act.","path":["KRS Chapter 423"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54086","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:41Z","sha256":"ead8526e0af82329bb0613f510052d4a345595115a92ec9c2ec08f1ba7c495d8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-423.340","next":"us-ky/krs-423.350"},"notice":"GroundRules: Original legal text.
