{"data":{"id":"us-ky/krs-423.350","jurisdiction":"us-ky","citation":"KRS 423.350","heading":"Effect of notarial act performed under authority of foreign state or","body":"international governmental organization -- Establishing authority of officer\nand genuineness of signature.\n(1) In this section, \"foreign state\" means a government other than t he United States, a\nstate, or a federally recognized Indian tribe.\n(2) If a notarial act is performed under the authority and in the jurisdiction of a foreign\nstate or constituent unit of the foreign state or is performed under the authority of a\nmultinational or international governmental organization, the act has the same effect\nunder the law of this state as if performed by a notarial officer of this state.\n(3) If the title of office and indication of authority to perform notarial acts in a foreign\nstate appears in a digest of foreign law or in a list customarily used as a source for\nthat information, the authority of an officer with that title to perform notarial acts is\nconclusively established.\n(4) The signature and official stamp of an individual hold ing an office described in\nsubsection (3) of this section are prima facie evidence that the signature is genuine\nand the individual holds the designated title.\n(5) An apostille in the form prescribed by the Hague Convention of October 5, 1961,\nand issued b y a foreign state party to the Convention conclusively establishes that\nthe signature of the notarial officer is genuine and that the officer holds the\nindicated office.\n(6) A consular authentication issued by an individual designated by the United States\nDepartment of State as a notarizing officer for performing notarial acts overseas and\nattached to the record with respect to which the notarial act is performed\nconclusively establishes that the signature of the notarial officer is genuine and that\nthe officer holds the indicated office.","path":["KRS Chapter 423"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49499","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:41Z","sha256":"428cd4efacc42a1eb2de49b00fd6326e01f6093fa1a133c4a9269c2593126868","source_id":"us-ky","stale":false,"prev":"us-ky/krs-423.345","next":"us-ky/krs-423.355"},"notice":"GroundRules: Original legal text.
