{"data":{"id":"us-ky/krs-425.066","jurisdiction":"us-ky","citation":"KRS 425.066","heading":"Temporary restraining order -- Preliminary injunction.","body":"(1) At or after the time he files his motion for writ of possession, the plaintiff may\napply for a temporary restraining order by setting forth in the motion a statement of\ngrounds justifying the issuance of such order.\n(2) The judicial officer may issue a te mporary restraining order if he determines that\nplaintiff's motion for writ of possession shows the probability that there is an\nimmediate danger that the property claimed may become unavailable to levy by\nreason of being transferred, concealed, or removed  or may become substantially\nimpaired in value.\n(3) If at the hearing on issuance of the writ of possession the judicial officer determines\nthat the plaintiff is not entitled to a writ of possession, the judicial officer shall\ndissolve any temporary restr aining order; otherwise, he may issue a preliminary\ninjunction to remain in effect until the property claimed is seized pursuant to the\nwrit of possession.","path":["KRS Chapter 425"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=18306","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:42Z","sha256":"dda564b33be7967594c0522ebec9f14d31d05ba9c14f899d6ea42bb7100afe2e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-425.065","next":"us-ky/krs-425.070"},"notice":"GroundRules: Original legal text.
