{"data":{"id":"us-ky/krs-425.086","jurisdiction":"us-ky","citation":"KRS 425.086","heading":"Issuance of temporary restraining order in lieu of writ of possession --","body":"Effect.\n(1) In any case where the plaintiff has made a motion for a writ of possession under\nKRS 425.076 the court may in its discretion deny the motion for the writ and issue\ninstead a temporary restraining order under this chapter if it determines that the\nrequirements of subsection (3) of KRS 425.076 are satisfied but that the issuance of\nthe temporary restraining order instead of the writ of possession would be in the\ninterest of justice and equity to the parties, taking into account the effect on the\ndefendant of issuing a writ of possession ex parte, the effect on the plaintiff of\nissuing the temporary restraining order instead of the writ and other factors that bear\non equity and justice under the circumstances of the particular case.\n(2) If the court issues a temporary restraining order under this section, the plaintiff's\nmotion for a writ of possession shall be treated as a motion for a writ of possession\nunder KRS 425.011.","path":["KRS Chapter 425"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=18314","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:42Z","sha256":"41f4897f31278a7046dc6ea3886758b81a88ee5e35af3413685124087ed09d36","source_id":"us-ky","stale":false,"prev":"us-ky/krs-425.085","next":"us-ky/krs-425.090"},"notice":"GroundRules: Original legal text.
