The appearance may be in person; or by\nthe affidavit of the garnishee, served and filed in the manner and at the time\nrequired for an answer by the Rules of Civil Procedure, disclosing truly the sum\nowing by him to th e defendant, whether due or not, and the property of the\ndefendant in the possession or under the control of the garnishee; and, in the case of\na corporation, any shares of stocks therein held by or for the benefit of the\ndefendant, at or after the service of the order of attachment.\n(2) If such garnishee or officer make default, by not appearing, the court may, on the\nmotion of the plaintiff, compel him to appear in person for examination, by process\nas in cases of contempt; or it may hear proof of any de bt owing or property held by\nthe garnishee to or for the defendant, and make such order in relation thereto as if\nwhat is so proved had appeared on the examination of the garnishee or officer.","path":["KRS Chapter 425"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=18421","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:43Z","sha256":"efa32fa6b246a182f442837f9a438287a952442cad61837fab325aeacd1eb39d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-425.510","next":"us-ky/krs-425.515"},"notice":"GroundRules: Original legal text.
