{"data":{"id":"us-ky/krs-426.205","jurisdiction":"us-ky","citation":"KRS 426.205","heading":"Sale of vacant and abandoned real property to enforce mortgage or lien --","body":"Proof of vacancy and abandonment -- Confirmation of sale and conveyance of\nproperty.\n(1) In an action otherwise properly brought to enforce a mortgage or lien against r eal\nproperty, including a lien pursuant to KRS 65.8801 to 65.8839 or KRS 65.8840,\nwhich has been determined by the court to be vacant and abandoned, a sale of the\nproperty shall be ordered expeditiously.\n(2) Real property shall be considered vacant and aba ndoned, for purposes of this\nsection only, if there has been no legal resident or other person legally entitled to\noccupy the property residing at the property for a period of forty -five (45) or more\nconsecutive days and two (2) or more of the following or  similar circumstances\nwhich would lead a reasonable person to believe that the property is vacant exist:\n(a) Overgrown or dead vegetation;\n(b) Accumulation of flyers, mail, or trash;\n(c) Disconnected utilities;\n(d) The absence of window coverings or furniture;\n(e) Uncorrected hazardous conditions or vandalism; or\n(f) Statements of neighbors, delivery persons, or government employees that the\nproperty is vacant.\nProof of vacancy and abandonment may be offered by affidavit filed at or after the\ntime of filing of the complaint by the plaintiff or other lienholder.\n(3) If the court makes a finding in the order of sale that the property is vacant and\nabandoned, the master commissioner shall sell the property within seventy (70) days\nof the order.\n(4) The plaintiff or other mortgage or lienholder in whose favor the judgment and order\nof sale were entered shall apply for an order confirming the sale within twenty (20)\ndays of the date of the sale and, unless there have been exceptions to the report of\nthe master c ommissioner, the court shall act on such application not later than the\nnext regularly scheduled civil motion or rule day.\n(5) The master commissioner shall make conveyance of the property on the date the\ncourt confirms the sale, or as soon thereafter as a ll costs and fees have been paid by\nthe foreclosing mortgagee or lienholder, or as soon as a third -party purchaser has\npaid the purchase price.","path":["KRS Chapter 426"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48736","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:43Z","sha256":"486d8e1f62f212cd841e65d4fcac45ceb84aee342665210eb8c48af58664d092","source_id":"us-ky","stale":false,"prev":"us-ky/krs-426.200","next":"us-ky/krs-426.210"},"notice":"GroundRules: Original legal text.
