{"data":{"id":"us-ky/krs-426.551","jurisdiction":"us-ky","citation":"KRS 426.551","heading":"Issual of execution after death of plaintiff -- Who treated as plaintiff.","body":"(1) The death of a party, after recovering a judgment, shall not prevent the issuing of an\nexecution afterward; but\n(a) Upon a judgment recovered by one (1) party, execution issued after his death\nmust be in favor of his representative or successor who is entitled to the\nproperty for which the judgment was rendered.\n(b) Upon a judgment recovered by several parties, execution issued after the death\nof one must be in favor of the other.\n(c) Upon a judgment recovered by several parties, execution issued after the death\nof all of them must be in favor of the last survivor's representative or\nsuccessor who would have been entitled to the property if the judgment had\nbeen recovered by such survivor only.\n(d) The clerk shall indorse on the execution the names of the decedent and of such\nsurvivor, representative or successor.\n(e) An execution issued in favor of a survivor, representative or successor of a\ndecedent shall be subject to the control of the court whence it issued for the\nprotection of any person interested therein.\n(2) Upon such execution, the person entitled thereto, according to the indorsement of\nthe clerk, shall be treated by the sheriff as the plaintiff therein.","path":["KRS Chapter 426"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=18492","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:44Z","sha256":"bfda6347351d7eb31fd376ca4bf923efe9a096122d8d4dce5a459b66d1c98646","source_id":"us-ky","stale":false,"prev":"us-ky/krs-426.550","next":"us-ky/krs-426.552"},"notice":"GroundRules: Original legal text.
