{"data":{"id":"us-ky/krs-426.680","jurisdiction":"us-ky","citation":"KRS 426.680","heading":"Procedure for levy of execution on jointly owned property.","body":"If an officer levy an execution upon personal property held by the execution debtor jointly\nwith another person:\n(1) The officer shall not deprive such person, without his consent in writing, of the\npossession of the property, except for the purpose of hav ing it inventoried and\nappraised, which he shall cause to be done pursuant to the provisions of KRS\n426.645;\n(2) The officer shall return the inventory and appraisement, with the execution, to the\noffice from which it issued; and shall state in his return the facts connected with the\nlevy, and the claim of the joint owner;\n(3) The execution creditor shall have a lien upon the property levied on, such as is\ngiven by law to an execution in the hands of an officer; and upon the aforesaid\nreturn, the creditor may enforce said lien by an action in equity;\n(4) If such creditor, at the commencement of his action or afterward, shall file an\naffidavit that he verily believes the property levied upon will be removed from the\ncounty or sold or otherwise disposed of wit h intent fraudulently to defeat his lien,\nthe court, or the District Court if no Circuit Judge is available, may make an order\ndirecting the officer to possess himself of the property so levied upon, unless bond,\nwith approved security, shall be executed t o the plaintiff in the execution, binding\nthe obligors in said bond to have the same forthcoming in obedience to any order or\njudgment of the court in the action; which bond shall be taken by the officer and\nreturned by him to the court in which the action is pending.","path":["KRS Chapter 426"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=18523","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:44Z","sha256":"f58e88fede4057a421c943727631960ba96eb9e417a81f19c83c21351fb625c7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-426.675","next":"us-ky/krs-426.685"},"notice":"GroundRules: Original legal text.
