{"data":{"id":"us-ky/krs-43.032","jurisdiction":"us-ky","citation":"KRS 43.032","heading":"Background checks required for prospective, current, and contracted","body":"employees with access to federal tax information -- Administrative regulations.\n(1) The Auditor shall require a national and state criminal background check for every\nprospective and current employee, including contract staff, with access to or use of\nfederal tax information and may enroll employees and contract staff in the rap back\nsystem for continuous monitoring. The criminal background check required by this\nsubsection shall include a fingerprint check by the Department of Kentucky State\nPolice and the Federal Bureau of Investigation, pursuant to the following\nrequirements:\n(a) The Auditor shall require each employee and contracted staff member with\naccess to or use of federal tax information to submit a complete and legible set\nof fingerprints to the Department of Kentucky State Police in the manner\ndeemed appropriate by the Department of Kentucky State Police and the\nFederal Bureau of Investigation;\n(b) The Department of Ken tucky State Police shall submit the fingerprint card to\nthe Federal Bureau of Investigation for a national criminal background check\nafter a state criminal background check is conducted;\n(c) The results of a national and state criminal background check sha ll not be\ndistributed or otherwise released by the Auditor, except that the Auditor:\n1. Shall provide an employee with the results of his or her national and\nstate criminal background check upon request; and\n2. May introduce the results, under seal, as evi dence in a legal proceeding\nthat involves a challenge to any personnel action taken by the Auditor\nbased in whole or in part on information contained in the results; and\n(d) Any fee charged by the Department of Kentucky State Police or for the\nFederal Bure au of Investigation background check or enrollment in the rap\nback system shall be an amount no greater than the actual cost of processing\nthe request and conducting the background check.\n(2) The Auditor shall promulgate administrative regulations in accor dance with KRS\nChapter 13A to implement this section.","path":["KRS Chapter 43"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56002","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:03Z","sha256":"5a11dcc4efacf3db17881565ee7d87c7e3109d03fefa973068bcb4b41cc91d8f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-43.030","next":"us-ky/krs-43.035"},"notice":"GroundRules: Original legal text.
